Abstract

This dissertation aims to demonstrate that it is desirable to form and operate the Nuclear Safety and Security Commission(NSSC) from the viewpoint of harmonizing the expertise and independence of nuclear safety regulations. As evidenced by the voluntary resignation of five members of the NSSC for disqualifications over four months from July 2018, Article 10 of the Act on the Establishment and Operation of Nuclear Safety and Security Commission prevents the normal operation of the Commission itself, contrary to its original intention to secure independence of the NSSC and enforce effective safety regulations. Therefore, it is now necessary to reflect on how it is desirable to establish a relationship between expertise and independence, rather than just emphasizing the facet of the expertise or independence of the nuclear regulatory body. To this end, this dissertation analyzes the historical context in which the nuclear regulatory body has secured expertise and independence from the viewpoint of harmonizing the expertise and independence of nuclear safety regulations. The core tasks of the NSSC presented in this dissertation are to optimize the grounds for disqualification of members of the NSSC, to strengthen the provisions of duty for avoiding conflicts of interest, and to ensure diversity of members including technical experts in implementing the principle of harmonizing the expertise and independence of safety regulations. In addition, it is desirable to promote the NSSC to a presidential body and expand the number of standing members to ensure the practical independence of the Commission.
