Abstract
In our country where the energy resource is insufficient, the atomic generation is inevitable. In the other hand, the security of the atomic generation is absolutely important. There were a lot of studies on the statutes regarding the nuclear energy in the ninties. Thereafter there was rare the study on them. Today, I think, it is necessary to make research into their problems, in particular from viewpoint of the security. There is a necessity of concrete and rational standard in the recognition of the security, one of the conditions of the construction permission and the operation permission. As the prevention of the atomic energy accident is the most important, the prevention law for the security of the atomic energy must be stressed. It is impossible to remove totally the danger of the atomic generation. The important thing is to reduce the dangerous characteristic of atomic energy in minimum and to manage that danger appropriately. It is possible and preferable to attach the security related condition to the construction permission and the operation permission. A legal basis must be made in order to attach security related condition also after the permission, if it is necessary. It is impossible to reduce the accident possibility of the atomic generation to zero. So we must decide the degree of the tolerable security of the atomic energy facility. The security of the atomic generation is not only a scientific technical concept but also sociological concept. it is important the people acceptancy of the security of the atomic energy facility. Consequently, in order to receive the people trust regarding the security of the atomic energy facility, atomic energy information must be opened to the public and the resident must be able to participate to an atomic energy administration and the operation of the atomic energy facility. From this viewpoint the existing law must be complemented.
