Abstract

This paper aims to examine criteria for determining islands/rocks by interpreting Article 121(3) under the UN Convention on the Law of the Sea. Ambiguous text of this provision gave rise to various interpretations among scholars. The South China Sea Arbitration between the Philippines and China marked a turning point by giving a thorough interpretation of Article 121(3). Thus, this paper analyzes this award of 12 July 2016 in comparison with literature review. In order to perform a comprehensive interpretation, this paper reviews conditions explicitly set forth under Article 121(3) as well as those which are not stated under the provision but examined by the Arbitration. This paper reveals that the Arbitration favored a strict interpretation of Article 121(3) so that scope of fully entitled islands is quite limited. Moreover, the Arbitration added “without artificial addition” to criteria for islands/rocks in order to prevent states’ excessive maritime claims. This interpretation is expected to restrict states’ attempts to transform rocks into islands by modifying natural conditions of maritime features. Finally, size of features appears to be taken into account when the Arbitration determined legal status of features in Spratly Islands. This position seems different from original intentions of drafters of Article 121(3); thus, the extent to which this part of the award contributes to interpretation of Article 121(3) relies on subsequent state practice and other international courts’ relevant decisions.
