Abstract

According to recent data on the Internet usage rate of children in Korea, the Internet usage rate of children aged 3 to 9 has increased rapidly in the past five years, with an overwhelming percentage of children using Internet. Many of the high-ranking videos are targeting children or featuring actual children themselves. Child influencers, also known as “kidsfluencers” are earning considerable amount of profits and influence. This article aims to draw attention to protecting child influencer’s rights on online platform. While the influence of child influencers has only been focused in a commercial terms, there has been relatively little discussion about the protection of these children’s rights. Only recently have discussions been held in France and the United States on the protection of children who appear on private internet broadcasting. Especially in France, it is noteworthy that a law was enacted for the first time in the world aimed at regulating commercial use of images of children under the age of 16 on online platforms. This Act protects child influencer's working conditions, property rights, and guarantees children's right to be forgotten. In Korea, in June 2020, the Korea Communications Commission(the “KCC”) announced guidelines for the protection of children and adolescents appearing in private internet broadcasting. These guidelines are meaningful in that they impose regulations in various areas, including appearance time, content, and online platform operators' obligations, to protect children's rights to appear on individual broadcasting on the Internet. However, these guidelines are limited in that they rely solely on autonomous compliance of the parties concerned. In particular, given that most of the child influencer’s videos on social media is produced by their own parents, it is necessary to deeply concern about how to protect children's rights in such circumstances. Producing private videos may give opportunities to record precious moments between parents and children, to have more enjoyable experiences, and to promote children's creativity through self-expression in the online world. While encouraging such positive actions, it is time to deeply scrutinize how to protect children’s rights in terms of the best interests of the children. In our current situation, where there is no protection legislation other than those guidelines of the KCC, the best interests of children, the actualization of self-regulation, and minimum level of protection for child influencer’s rights are necessary to consider.
