이 글은 세대 간 갈등 양상이 심화되고 전 사회적 영역에서 지속가능성(sustainability)이 중대한 화두로 떠오른이 시점에서, 미래세대를 염두에 두면서 현재의 헌법적 의사 결정을 가능하게 하는 규범적 방안을 마련하는 데 목적을두고 있다. 현세대가 물려준 물질적·정신적 유산 속에서 삶을 영위할 수밖에 없는 미래세대에게 좀 더 나은 삶의조건을 남겨주는 일은 선대로서의 마땅한 도리이자 의무이다. 그러나 현세대는 물론 미래세대의 몫으로 남겨 두어야할 것조차 무분별하게 현재의 이익을 위해 차용하고 있는 우리의 현실을 감안하면, 단순히 인간의 덕성에만 호소하여자발적 의무를 이끌어 내는 차원에 더이상 머무를 수 없다는 결론에 도달한다. 그간 세대 간 정의(intergenerational justice) 등 철학적 담론이 꾸준하게 학문적 반향을 일으키기는 하였지만, 그것이 가시적 수준에서 실천적 법규범으로구현되지 못하였던 사실을 보더라도, 이제 법적 차원에서의 구체적 조치가 절실한 상황이 되었다고 생각한다. 이러한 상황에서 미래세대에게 민주적 자결권을 인정하는 것이 매우 중요하다. 특별히 미래세대의 민주적 자결권부여의 방법론으로서 제안된 데미니 투표의 민주적 역할을 통해 변화된 민주주의 환경의 주권자 역할을 그려볼수 있다. 미래세대는 단순히 보호의 수단이 아니라, 정치적 실체를 가진 의제적 집단이다. 이들에게 민주적 자결권을부여함으로써 이들을 헌정 공동체의 일원으로 받아들이고 현재인들과 공동의 이익을 추구하도록 하는 헌정적 사고로전환하여야 한다.
Abstract
This article aims to formulate a normative methodology to make present constitutional decision makings considering future generation while generational conflicts get worse as time goes by. Societies seek sustainability not to demolish environment and public finance. Current generation has moral and legal liabilities or obligations to future generation that is bound by material and psychological inheritance from the past in terms of bequeathing better life conditions. However, as a member of current generation, we borrow what future generation owns from them without discretion. We disregard any moral requirements with or without recognition. This is the main reason we should make a binding rule to forbid this behavior. Although philosophical discussions on intergenerational justice have drawn academic attentions so far, they could not be obviously self-identified into a binding rule. Now we should make a normative measure without hesitation. Under these circumstances, it is very important to accept future generation’s right of democratic self-determination. Especially, through Demeny voting that has been suggested as a methodological institution for realizing future generation’s democratic self-determination, a newly changed type of sovereignty can be formed. Future generation is not a subject of protection, but an invisible active entity of political role. By providing them with the right of democratic self-determination, we should include them in our constitutional community, and let them pursue their common interests with present people.
