이 논문에서는 국민 주권의 의미와 제도를 구성적 ‘시민 헌정주의’라는 특정한 관점에서 고찰한다. 이를 위해, 첫째, 국민 주권을 시민적으로 재구성하는 관점을 제기한다. 둘째, 국민 주권 사상의 다양한 흐름들을 개관한다. 셋째, 이러한 흐름들중에서 민중 헌정주의를 재구성하는 시민 헌정주의 흐름을 논의했다. 넷째, 구성적 시민 헌정주의에 기반한 시민 주권의 기본 요소와 헌정 개혁의 방향을 논의한다. 다섯째, 구성적 시민 주권을 경제적·지역적·글로벌 차원의 공화주의 과제와 연결하는 방향을 제시한다.
Abstract
This paper examines the meaning and institutions of popular or national sovereignty from the specific perspective of constructive “civic constitutionalism.” To this end, first, it proposes a perspective that reconstructs the concept of popular or national sovereignty in a civic manner. Second, it provides an overview of various currents in the idea of popular sovereignty. Third, it discusses the civic constitutionalism that seeks to reconstruct popular constitutionalism within these currents. Fourth, it discusses the fundamental elements of civic sovereignty and the direction of constitutional reform based on constructive civic constitutionalism. Fifth, it suggests ways to connect constructive civic sovereignty with republican tasks at the economic, regional, and global levels.
