Abstract

As environmental problems, such as global warming, cause irreversible damage to human beings and the environment, we must deal with environmental problems in a precautionary manner. The precautionary principle may be construed as principle designed to deal with new characteristics of present-day environmental problems, that is, principle concerning decision-making under scientific uncertainty (precautionary environmental regulations). On the precautionary principle like this, hot debates are conducted in the United States between those who advocate and those who denounce the relevant principle. Futhermore, recently those who criticize the precautionary principle or environmental regulations lead ‘sound science movement’ which raises a question about scientific inaccuracy of the administrative regulatory basis in order to provide more scientific manner to administrative regulations. However, such reform movement will put the society back “before environmental law”, that is, countermeasures are taken after actual damage to the environment occurs. The objective of precaution and legal structure of environmental law of the United States are intended to evade delay in environmental regulations or administrative omissions in order to protect human health or the environment even though there is scientific uncertainty. A number of precedents including the ruling in the case of Ethyl Corporation also admitted precautionary environmental regulations under scientific uncertainty: Provided, That in the ruling in the case of Massachusettes v. EPA in the federal appeals court, which may be called a global warming lawsuit, it may be considered a mistake of the EPA as the EPA not only admitted that omissions were based on scientific uncertainty but also made the distinction between risk assessment and risk management ambiguous by combining risk assessment with risk management (i.e., admission of extensive policy considerations in the risk assessment of the EPA). In a word, environmental law of the United States does not deny the concepts of precaution, and precautionary environmental regulations are expected to be expanded and strengthened further notwithstanding scientific uncertainty.
