환경법의 과학 관련 규정에 대한 小考

환경정책의 수립과 이를 제도적으로 구현하기 위한 환경법은 과학적인 자료에 중요한 기반을 두고 있다. 정확한 과학적 정보를 환경정책 결정에 통합하는 것은 그러한 결정들이 사회를 설정된 목표를 향해 나아갈 수 있도록 하고, 보다 근본적으로는, 사회적 선호를 정확하게 반영하는 목표를 설정하기 위해 반드시 필요하다. 환경법은 이런 차원에서 과학적 자료의 확보와 활용에 대한 명시적인 규정을 두고 있는 경우가 많다. 그러나 과학･기술의 발전에도 불구하고 과학적 정보는 여전히 공백으로 남겨져 있거나 불확실성을 내포하고 있는 경우가 많은 것이 현실이며, 또한 과학적 자료의 생산과 해석에 있어 엄밀한 객관성과 중립성을 확보하는 것 또한 가치판단과의 밀접한 연관성으로 인해 많은 어려움이 있다고 할 수 있다. 따라서 환경법은 이러한 과학과 정책과의 밀접한 관련성과 현실적 어려움을 직시하면서 바람직한 정책 결정이 내려질 수 있도록 제도적인 기반을 제공해주어야 할 것이다.
Abstract
Environmental Policies and the environmental laws aimed to implement the policies are based on the scientific data and information. Incorporating accurate scientific information into environmental policy decisions is essential to ensuring that those decisions move society toward its goals, and to identifying goals that accurately reflect societal preferences. In this regard, some environmental laws specifically provide articles about mandatory use of scientific information. However, in spite of the progress of science and technology, still there are many blank spaces or uncertainty in our scientific knowledge, and because of the close relation with the value judgment, it is very difficult to ensure the exact objectivity and neutrality in the produce and interpretation of the scientific information. Therefore, environmental laws are needed to provide institutional foundation for desirable policy decisions, facing up to the close connection between the science and the policy, and the practical difficulties.
