자원의 효율적인 이용과 폐기물의 재활용 등을 촉진하여 자원의 소비를 억제하고 환경에 대한 부하를 줄이는 자원순환형 사회체제를 확립하는 것이 전세계적으로 오늘날 폐기물 정책의 핵심적인 방향으로 제시되고 있다. 이러한 측면에서 EU 등에서는 ‘폐기물 종료(End-of-Waste)’ 제도를 도입ㆍ시행하고 있는데, 이는 폐기물이 일정한 요건을 충족할 경우 더 이상 폐기물이 아닌 상태로 시장에서 자유롭게 거래될 수 있도록 非폐기물(순환자원 또는 제품)로 간주하는 것을 말한다. 우리 폐기물 관련 법률에서는 이에 대해서 명시적인 규정을 두고 있지 않으나, 폐기물이 일정한 공정을 거쳐 더 이상 폐기물로 관리할 필요가 없게 된 경우에도 여전히 폐기물로 보아 관리하는 것은 과도한 규제라고 할 수 있으며, 자원순환을 촉진한다는 측면에서도 바람직하지 않으므로 폐기물이 폐기물로서의 지위를 벗어나 더 이상 폐기물로 관리되지 않게 되는 시점과 그 요건에 대한 일반적인 원칙을 명확히 법률에서 규정하고, 하위 법령에서 폐기물의 종류별로 구체적인 종료기준을 제시하는 것이 필요하다고 할 것이다. 본 논문에서는 EU, 독일, 영국, 일본, 미국 등의 입법례에 대한 비교법적인 검토를 바탕으로 우리 법제에의 도입 필요성과 구체적인 도입방안을 종합적으로 고찰하고 입법안을 함께 제시하였다. 우리나라에서 폐기물로서 엄격한 관리를 받는 지위로부터 벗어나 자원 또는 제품으로 관리되도록 하는 기준을 정함에 있어서는 해당 물질 또는 물건에 함유되어 있는 유해물질이 인체와 환경에 노출되어 부정적인 영향을 줄 우려가 있는지를 사전에 충분히 고려할 수 있도록 해야 할 것이다.
Abstract
The establishment of resource circulation society system which restrains the consumption of resources and reduces the burden on the environment through the promotion of efficient use of resources and recycling of wastes has become the most important direction of today's waste management policy. From this perspective, ‘End-of-Waste’ system has been introduced, which enables wastes to be transformed into non-waste(second material or goods) and to be traded in the market. Our waste laws do not have any definite clause on this matter. But, it would be an excessive regulation and unnecessary barrier for the promotion of resource circulation if we impose legal controls for waste on the material which has been already processed and need not to be controlled as waste any more. So it would be desirable to introduce the ‘End-of-Waste’ into our legal system for waste management. And, to prevent any possible adverse effect, we need to make a clear rule on the condition and timing of ‘End-of-Waste’ in a law, and to provide specific criteria for each waste in the lower administrative regulations. In this thesis, the legislative cases of EU, Germany, France, United States, United Kingdom, and Japan have been studied comprehensively by comparative method to grasp the meaning of the ‘End-of-Waste’ and the necessity of introduction. And concrete scheme of introduction into our legal system, including legislative draft, has been presented. In making criteria for any material or object to get out of the strict regulation on the waste and to be managed as resource or good, the thorough consideration on the possibility of the harmful substances in the material or object to cause adverse impact on the human health and environment should be guaranteed in advance.
