이 글은 폐어구의 범람으로 극심한 해양환경 피해가 지속되고 있는 시점에서, 사전예방의 원칙 및 원인자책임 원칙에 입각한 폐어구 관리방안을 제시하고자 작성되었다. 이를 위하여 폐어구의 환경적 문제점 및 관리 실태를 파악하고, 어구 및 폐어구 관리에 관한 현행 법제를 환경법적 시각에서 분석･평가하며, 나아가 문제점 극복을 위한 법적 해결방안을 모색하고 있다. 현행 어구관리법제는 폐어구 발생을 사전적으로 예방･저감하려는 노력이 부족했으며, 이미 발생한 폐어구에 대해서도 그 원인자에게 책임을 묻기 곤란한 구조로 운영되고 있었다고 평가할 수 있다. 하여 폐어구로 인한 환경상 위해를 방지하기 위해서는 (ⅰ) 어구의 전 생애주기에 걸친 체계적 관리가 가능하도록 기반을 마련하고, (ⅱ) 불법어구 관리에 있어서 사각지대를 없애고 친환경어구의 인증을 의무화하는 식으로 어구의 친환경성을 강화하며, (ⅲ) 조업질서 확립을 통해 법정사용량을 준수케 하는 등 폐어구 관리에 있어서 사전예방적 접근방식을 도입해야 한다. 또한 (ⅰ) 원인자 규명을 보다 용이하게 할 수 있도록 어구실명제를 개편하고, (ⅱ) 어구 투기가 금지되는 장소적 범위를 확대하며, (ⅲ) 폐어구 처리책임을 명확히 하고 처리비용을 내부화하는 등 원인자책임 원칙에 충실한 폐어구 관리방안을 구축해야할 것이다.
Abstract
Today the marine environment and eco-system are being destroyed by abandoned, lost, or otherwise discarded fishing gear(ALDFG). In this circumstance, this study was conducted to suggest legal management methods of ALDFG based on the preventive principle and the polluter pays principle. This study showed the environmental risks caused by ALDFG and; management status about it, made a legal analysis of the main contents and issues of the current law, and suggested its legal improvements. The current law has limitations because there is insufficient effort to manage ALDFG preventively, and it is hard to make a polluter responsible. To prevent the environmental risks caused by ALDFG, the preventive approach must be applied in managing. The specific ways are as follows: first, establish a legal frame to manage the whole life-cycle of fishing gear; second, reinforce environment-friendliness by regulating illegal fishing gear thoroughly and by compelling the certification of environment-friendly fishing gear; and third, make fishermen observe legal usage by restoring the fishing order. Besides, The polluter pays principle must be realized in managing. The specific ways are as follows: first, revise the real-name fishing gear system to identify the polluter easily; second, enlarge the area where dumping is restricted; and third, clarify the disposal responsibility and internalize disposal expenses.
