현대 사회에서 위험은 우리 주변 모든 곳에 존재하고 있다. 반면 그것을 막을 수 있는 자원은 희소하다. 따라서 우리는 어쩔 수 없이 효율적인 자원 배분이라는 선택의 상황에 직면하게 된다. 이는 우리가 어떤 한 위험요소에 자원을 집중적으로 쏟아 붓는다면 다른 위험요소에 대하여는 소홀해질 수밖에 없다는 것을 의미한다. 기후변화에 대한 대응의 문제도 마찬가지이다. ‘기후변화’ 상황에서 특정한 위험에 집중하여 특별한 대응을 하는 것은 기후변화와 관련된 다른 위험 또는 다른 종류의 위험에 대한 노출의 증가를 가져올 수 있다. 결국 기후변화대응규제의 설계에 있어서도 합리적인 선택으로서 효율적인 자원배분을 고려하여야 할 것인데, 이때 고려될 수 있는 요소로서 세대간 효율의 개념과 세대간 형평의 개념이 있다. 한편 장기간에 걸쳐서 발생하는 기후변화의 문제에 대한 적정한 대응의 내용에 대한 판단의 근거로서 비용편익분석이 이루어져야 하는데 그 과정에서 적정한 사회적 할인율을 선택이 중요한 쟁점이 된다. 이 논문에서는 기후변화대응규제의 설계에 있어서 이러한 사회적 할인율 선택의 문제와 관련된 제반 쟁점들을 살펴보았다. 사회적 할인율 선택의 문제를 둘러싼 윤리주의자의 입장과 실증주의자의 입장을 비교해서 검토해보고, 선택가능한 사회적 할인율로서 자본의 기회비용과 사회적 할인율 사이의 선택의 문제와 관련된 제반 쟁점을 검토하였으며, 최종적으로 행정청에 의한 사회적 할인율 선택결정에 대한 사법심사의 문제를 검토함으로써 논의를 마무리하였다.
Abstract
In establishing regulatory system on climate change which affects the long term benefit and cost of people and community, the process of discounting the future value of benefit and cost into present value is required. The final outcome of benefit-cost analysis in climate change regulation is deeply related to the issue of what kind of social discount rate is used in the analysis. For example, a certain project or regulation on carbon emission which can make the benefit of $400,000,000,000 in the future with $100,000,000,000 cost under 1.4% of social discount rate can be evaluated to make $21,000,000,000,000 benefit under 5.5% of social discount rate. In this sense, choosing a reasonable social discount rate is a very critical issue in establishing and assessing the climate change regulatory system. Firstly, in this paper, I reviewed the two different argumentations on social discounting of benefit and cost of climate change regulation. The debate between ethicists and positivist stems from different understandings of the concept of intergenerational neutrality from the perspective of intergenerational efficiency and intergenerational equity. The second issue dealt with in this paper is between the two different suggestions of social discount rate, Opportunity Cost of Capital(OCC) and Social Rate of Time Preference(SRTP), which one can be a better discounting rate. Finally, I reviewed the topic of judicial review on agency decision making of social discount rate from the viewpoint of comparative legal analysis.
