미국 오바마 행정부의 기후변화 에너지 정책

초록

2013년 6월 오바마 대통령은 임기 2기 동안의 기후변화 에너지 정책의 청사진이라 할 수 있는 기후행동계획(Climate Action Plan)을 발표하였다. 동 발표는 재임 선거기간 기후변화 문제를 가장 중요한 국정아젠다로 삼을 것이라는 오바마 대통령의 공약을 이행하는 차원이자 오바마 행정부의 정치적 의지를 확인하는 자리였다. 특히, 미국 의회가 2009년 이후 기후변화 입법에 실패한 이후 연방정부 차원의 기후변화법이 부재한 상황에서 오바마 행정부는 대통령의 권한으로 기후변화 에너지 정책을 계속 추진 의지를 확고히 하였다. 의회의 입법활동 없이 대통령의 권한으로 진행할 수 있는 정책이행수단에는 ①행정기관의 규칙제정(regulation), ②집행명령(executive orders), ③대통령선언(presidential proclamations), ④대통령메모(presidential memoranda). ⑤입법제안을 위한 행정요청(recommending legislation: executive communication) 등이 포함된다. 오바마 행정부는 이러한 권한을 십분 활용하여 의회의 입법 부재 상황에서도 의욕적으로 기후변화 정책을 추진하였고 소기의 성과를 거둔 것으로 평가된다. 그러나 의회의 도움 없이 행정부만의 노력으로 진행되는 미국의 에너지기후정책은 산업계의 반발로 소송에 휘말리기도 하였으며, 근거법인 청정대기법만으로 다양한 기후에너지정책을 이끌고 나아기에는 어느 정도 한계가 있는 것도 사실이다. 남은 임기동안 오바마 행정부의 정책이 탄력을 받을 수 있을지, 그리고 오바마 정권 이후에도 살아남을 수 있을지 귀추가 주목된다. 본 논문은 오바마 대통령 당선 이후 미국의 국내 온실가스 감축 정책분야에 대해 집중 분석하려고 한다. 특히 입법부의 개별 입법 없이 기후변화 법정책을 이끌고 있는 오바마 행정부의 정책배경과, 대통령의 정책이행 권한과 법적 효과, 그리고 구체적인 기후변화 에너지 정책을 살펴본 다음 정책 효과에 대한 평가와 시사점을 알아보고자 한다.

Abstract

In June 2013, the President Obama released ‘Climate Action Plan’ which included the blueprint of the climate energy policy under his second term. The Plan reiterated the President's political will that climate policy would be at the top priority national agenda during his second term. In particular, his climate policies draw much attention because they are implemented under the sole executive authority as US Congress has not been able to promulgate any comprehensive climate legislation. The executive power to implement policies include regulations, executive orders, presidential proclamations, presidential memoranda, recommending legislations through executive communications, among others. The President Obama utilized all of these authority options when leading US climate energy policies, some of which have been proved as successful. However, many of his initiatives have been sued by the industry and have gone through judicial review, some of which has led to the rejection of EPA interpretation. Also, Clean Air Act may not be an appropriate legal ground for climate energy regulations. There is much attention toward the success of Obama Administration's climate policies and it is also interesting to see if his legacies will survive after his term. This article analyzes the US climate and energy policy during the Obama administration. In particular, this article describes the background of the US climate and energy policy, the legal authority of the presidential power in implementing policies and major climate and energy initiatives under the Obama administration. The article concludes that the Obama administration has successfully led a series of policy initiatives based on the presidential power, executive rule-making and economic stimulus package supporting clean energy despite the inaction of the Congress. The article also points out the legal instability of the Obama climate policies which heavily rely on the Clean Air Act.
