Abstract
The gaps between development and regulation of emerging technologies are widening. In this situation, soft law can narrow the gaps through its characteristic of flexibility, speed and adaptability. Although it may be vastly used in a broad spectrum unlike hard law that require formal legislative procedures, it may affect legal rights or obligation of third party in the process inducing them to do or not to do certain behavior. EU, meanwhile, draws a conclusion that soft law is not legally binding, but it can produce legal effect in the course of judicial review by ECJ and theoretical discussion. Soft law is being utilized in many areas including regulation of nanomaterials as representative of emerging technologies. Before being regulated by formal legislation, they were regulated by ISO or code of conduct. But after separately stipulated in the REACH regulation, Guidances of ECHA, a soft law, provide explanations of regulation of nanomaterials. In this regard, soft law still have an legal impact directly or indirectly. Though this article did not conduct a comparative study, it will be a basis for related research, because it is regulated by soft law like guidelines in korea too.
