‘본립도생(本立道生)’은 기본이 바로 서면 나아갈 길이 생긴다는 의미로, 순환경제사회로의 성공적인 전환을 위해 우리가 나아가야 할 방향을 잘 설명해 준다. 순환경제의 기본은 자원의 소비를 최소화하고, 제품을 오래 사용하는 것으로, 이러한 원칙과 체계가 확립되면, 우리 사회는 자연스럽게 순환경제사회로 나아갈 수 있다. 최근 순환경제 실현에 있어 주요 관심사로 대두되는 분야는 바로 전기자동차 배터리이다. 수송부문의 탄소중립을 위해 시행된 전기자동차 보급은 배터리 자원순환 문제로 되돌아왔다. 배터리는 미래의 석유, 미래산업의 쌀로 불리며 그 중요성이 날로 커지는바, 본 논문은 배터리의 전 주기에 걸친 자원순환을 도모하기 위한 규제법적 방안에 대해 논하고자 한다. 전 세계적으로 배터리 자원순환 시장은 산업 초기 단계인바, 배터리의 재활용가치와 자원효율성을 고려한 규제설계 및 체계 정립이 필요하다. 특히 우리나라에서 사용후 배터리 재활용시장은 산업 초기 단계인바, 배터리의 재활용가치와 자원효율성을 고려한 배터리 설계 및 제조 체계가 정립될 필요가 있다. 다만, 본 논문은 모든 사용후 배터리를 규제대상으로 정하는 것이 아닌, 최소한의 규제대상을 정하기 위한 기준을 마련하고, 최대의 규제효율을 도출하기 위한 방안을 고려하고자 한다. 이를 위해, 규제의 기본이 되는 배터리 및 사용후 배터리에 대한 용어를 명확히 정의하여야 한다. 그리고 재활용가치 및 자원효율성을 기준으로 생산자책임재활용제도와 더불어 민간 주도의 규제를 도입하여 통합적이고 효과적인 사용후 배터리 재활용체계 구축을 도모하고자 한다.
Abstract
The phrase “Bonrip Doseong(본립도생)” meaning that a firm foundation leads to a clear path, aptly describes the direction needed for a successful transition to a circular economy. The core of the circular economy is minimizing resource use and extending product lifespans. When these principles and systems are well-established, society can naturally progress toward this goal. A key focus area in achieving a circular economy is the issue of electric vehicle (EV) batteries. While EV adoption supports carbon neutrality in transportation, it has highlighted challenges in battery resource circulation. Batteries, often called the “oil of the future” or the “rice of future industries,” are becoming increasingly important. This paper explores regulatory and legal measures to promote resource circulation throughout the battery lifecycle. Globally, the battery recycling market is in its early stages. In South Korea, the recycling market for used batteries is similarly nascent, requiring systems that prioritize recycling value and resource efficiency. This paper proposes establishing clear criteria to regulate only essential areas and maximize efficiency. Key steps include defining terms for batteries and used batteries, and integrating producer responsibility recycling with private-sector-led measures. This approach aims to create an effective and comprehensive recycling system for used batteries.
