다양한 도덕적 갈등들의 해소를 위해 공통도덕이 요망되고 있는 현실에서 공통도덕의 정립은 가능한가? ‘인권의 원칙’이 타당한 보편도덕인 공통도덕의 토대를 마련해 준다. 현재 또는 장래의 각 행위자가 자신에게 있어 자유와 안녕이 필수적 자원이라고 믿고 있다는 사실로부터 그는 또한 논리적으로 자신이 자유와 안녕에 대한 권리를 갖고 있으며, 현재 또는 장래의 다른 행위자들 역시 자신과 마찬가지로 이들 권리를 소유하고 있다는 점을 사실로 받아들여야 한다는 것이 밝혀진다. 따라서 이들 권리는 현재나 장래의 모든 행위자들에게 보편적으로 배분되어 있기 때문에 그것들은 공통의 인권이며, 또한 그것은 만인에 대한 만인의 권리이므로 각자는 권리의 소유자일 뿐만 아니라 다른 모든 사람들에 대해 그들의 권리를 존중 또는 증진시켜야 하는 의무 또한 지닌다. 이러한 방법을 통해 인권의 원칙이 규범적이며 실질적인 공통도덕의 토대를 제공해 준다는 점이 해명된다. 인권이 공통도덕의 토대를 제공해 준다는 주장에 대한 두 종류의 반대, 즉 ‘이기주의’의 입론과 ‘민족중심’의 논변을 비판적으로 검토한다. 이로부터 ‘인권공동체’ 또는 ‘권리공동체’, 그리고 ‘세계인권선언’ 모델로의 발전적 지향을 도모한다. 인권의 원천에 관한 물음에서는 ‘구성주의 인권론’을 옹호하면서, 인권은 인간이 존재하는 방법에 관한 것이라기보다는 인간으로 될 수 있는 규범적 과제에 관한 것임을 강조한다.
Abstract
In today, two or more groups are in conflict over some moral issues. We would like to the conflict resolved peaceably and reasonably. Agent has two generic features of action that characterize the genus or category of action as a whole. These features of action provide the justificatory basis of the Supreme Principle Morality. Every agent has right and obligation of that principle. The general principle of these obligation and right may be expressed as follow : Act in accord with the generic rights of your recipients as well as yourself. This is the Principle of Generic Consistency(PGC). Normative moral conception, that is the Principle of human rights or the Principle of Generic Consistency can be rationally established as valid for all persons. The idea of human rights involves what we may call the community of rights. And we expect development of the Universal Declaration of Human Rights all over the world in the future that may be called as the Universal Declaration Model.
