최근 북한의 교육법제 동향에 대한 이해 –고등교육법을 중심으로-

본 논문은 최근 북한 교육제도의 체제와 입법 경향을 『조선민주주의인민공화국 고등교육법』(2011년)을 통하여 탐색하면서 최근의 북한 교육제도와 그들의 인식 변화의 일부를 이해하고자 하는 의도로 쓰여 졌다. 이를 위해 본 고에서는 북한 사회가 대외 개방의 필요성과 법률에 의한 지배의 필요성에서 다양한 영역에서 법제화가 이루어지고 있으므로 교육법, 특히 고등교육법의 이해는 중요하다는 전제에서 출발하였다. 그리고 북한 교육법에서의 규정을 이해하기 위해서는 그동안 북한 교육제도가 어떠한 모습이었는가를 파악할 필요가 있기 때문에 북한의 교육제도 변천 과정을 살펴보았다. 이어 제 3장에서는 가장 최근에 제정된 북한의 고등교육법을 다른 북한 교육법이나 강령과 비교하면서 분석하여 동향을 파악하고자 하였다. 제 4장에서는 이러한 분석을 토대로 법 제정의 과정이나 법 인식이 변화되고 있다는 점, 법 규정의 상세화와 그것을 대외적으로 드러내고 있다는 점, 대내적으로 법을 대중에게 알리고 그것의 준수를 강조하고 있다는 점, 국제 교류에 대한 관심이 높아지고 있다는 점, 후원회와 같은 자본주의적 현상을 나타내고 있다는 점을 특징으로 제시하였다. 그리고 2012년에 북한 최고인민회의에서 새로이 법령으로 채택된 「전반적12년제의무교육을 실시함에 대하여」를 살펴봄으로써 북한의 최근 교육 제도의 동향을 이해하고자 했다.
Abstract
The purpose of this paper is to understand about North-Korea(NK) through the recent trend of NK education law. Especially through the higher education law of Democratic People's Republic of Korea (DPRK:2011), I intend to understand the changes of the education system & NK. That is very important process for the korea's unification because we should know the correct fact of NK. For the purpose of this goal, in the chapter Ⅰ, I investigated the reasons why enacting the law is increasing in NK. The main reasons are reflecting the needs of establishing legalism & the open society. In the chapter 2, I investigated the transition process of the education system of NK. In the chapter 3, I analyzed the higher education law of DPRK(2011) comparing to other education law of NK, including the these of socialism education, and the fundamentals of educational act. And then, in the chapter 4, I proposed several meaningful features of NK's law changes. Those are as follows: the change of the enacting process & recognition of the raw, the specification of law articles & announcing them abroad, the internally announcing the people & emphasizing the observation of the law, the upheaval of interesting in the international exchange in the domain of education as other parts, the representing the features of the capital legislation as like organizing a supports' association. And, I investigated that new educational law of NK which is enacted 2012 year.
