규칙 결과주의는 합리적인 도덕적 의사결정 절차 및 평가 기준인 ‘최적의 규칙’과 결과주의의 목표인 ‘최적의 결과’가 상충할 때 둘 중 하나를 선택해야 한다는 기로에 선다. 만약 결과를 최적화하기 위해 최적의 규칙을 위반하는 쪽을 선택한다면 규칙 결과주의는 행위 공리주의와 동일한 결과를 산출할 뿐이다(붕괴 반론). 반면 최적의 규칙을 고수하기 위해 준최적의 결과를 선택한다면 규칙 결과주의는 맹목적으로 규칙숭배를 강요하는 것이다(규칙숭배 반론). 이렇듯 규칙 결과주의는 상호 모순되는 요구를 부정합적으로 결합하고 있는 이론이다(부정합성 반론). 도덕률 규칙 결과주의는 규칙 결과주의가 가지고 있는 트릴레마를 해결하기 위해 수용규칙을 명시하고, 재난방지 규칙을 도입하는 한편, 편익 총합의 극대화의 요구를 거부한다. 이러한 도덕률 규칙 결과주의의 시도는 붕괴 반론에 타당한 대응을 한 것으로 보이지만, 재난의 문턱 한계를 제시하지 않음으로써 규칙숭배 반론에 대한 대응은 난항을 겪는 것으로 보인다. 규칙숭배 반론과 이에 대한 대응의 부족함으로 인한 부정합성 반론을 극복하고자 도덕률 규칙 결과주의는 공평하게 정당화된 규칙의 공평한 옹호 가능성이라는 메타결과주의적 정당화를 제시한다. 이러한 메타결과주의적 정당화의 타당성이 도덕률 규칙 결과주의가 트릴레마로부터 합당하게 벗어날 수 있는 타당한 이론인지를 결정짓게 될 것이다.
Abstract
Rule consequentialism is at the crossroads of having to choose one of the two when there is a conflict between the ‘optimal rules’, a rational moral decision-making procedure as well as criterion for evaluation, and the ‘optimal consequences’, the goal of consequentilaism. Rule consequentialism only produces the same action guiding principles as act utilitarianism if one chooses the suboptimal rules to optimize the consequences(collapse objection). On the other hand, rule consequentialism is blindly forces rule worship if one chooses the suboptimal outcomes to comply to the optimal rules(rule worship objection). As such, rule consequentialism is a theory that incoherently combines mutually unsupported demands(incoherence objection). Moral code rule consequentialism specifies the acceptance rules, introduces disaster prevention rules, and rejects the demand for maximizing benefit aggregation to solve the trilemma of rule consequentialism. The moral code rule consequentialism’s attempt seems to have made a reasonable defence to the collapse objection. However, by not stipulating the limits of the threshold of disaster, it seems that the defence to the objection to rule worship is difficult. The moral code rule consequentialism suggests a meta-consequentialist justification of impartially defensible of impartially justified rules in order to overcome the rule worship objection and the incoherence objection caused by the lack of defence to rule worship objection. The plausibility of this meta-consequentialist justification will determine whether the moral code rule consequentialism is a valid theory that can reasonably escape from the Trilemma objection.
