초록

후커는 비공리주의적 완전 규칙 결과주의를 제안한다. 후커는 엄밀한 공평성 요구와 그것에 기초한 총합주의적 극대화 요구를 거부함으로써 비공리주의를 선택한다. 또한 결과주의의 구성요소인 도덕적 옳고 그름의 논제, 도덕적 의사결정 절차의 논제, 도덕적 제재의 논제를 규칙 결과주의적 기준으로 통일함으로써 완전 규칙 결과주의 버전을 제시한다. 비공리주의적 완전 규칙 결과주의는 첫째 신세대의 압도적 다수에 의한 일반적 내면화 규칙 결과주의, 둘째 재난 방지 규칙 결과주의, 셋째 분배에 민감한 약자 우선주의적 규칙 결과주의라는 특징을 지닌다. 이러한 특징을 지닌 비공리주의적 완전 규칙 결과주의는 이 이론의 조상인 공리주의가 직면했던 자멸성 반론과 역직관성 반론을 극복하는 듯하다. 그러나 새롭게 제기되는 공평성과 약자 우선권이라는 두 직관의 상충 문제, 그리고 규칙 공리주의가 안고 온 트릴레마인 붕괴 반론, 비정합성 반론, 규칙 숭배 반론을 극복할 수 있는지가 이 새로운 윤리 이론의 타당성을 결정짓게 될 것이다.

Abstract

B. Hooker suggests Non-utilitarian Full Rule Consequentialism. Hooker chooses non-utilitarianism by rejecting the demand of the strict impartiality and of the aggregative maximization based on it. In addition, by unifying the constituent elements of consequentialism, the thesis of moral right and wrong, of moral decision-making procedures, of moral sanctions, it can become a version of full rule consequentialism. Non-utilitarian full rule consequentialism is characterized as (1) whose general internalization by the overwhelming majority of everyone everywhere in each new generation, (2) endorsing a motivation of prevent disaster rule, (3) distribution-sensitive prioritarianism. I think that the non-utilitarian full rule consequentialism overcomes the self-defeating and counterintuitive objections that utilitarianism, the ancestor of this theory, faced. But, whether it can overcome (1) the newly raised problems of the conflict between the two intuitions: strict impartiality and prioritarianism, (2) the trillemma of rule utilitarianism: the objections of collapse, of incoherence, of rule worship will determine the plausibility of this new ethical theory.
