Abstract

The new information communication technologies not only provide promising opportunities, but chances of misuse as well. The information drive of the society requires new prospects for the protection of human rights in the information era. The Information society has fundamentally conflicting natures in that it has to protect the information on the one hand, and to activate the use and dissemination of it on the other hand. In this regard, some of information human rights are clashing each other; for example, strongly-protected privacy threatens free speech. Based on these analyses, this study suggests several policy recommendations regarding how to protect information human rights in the virtual space. According to Lessig, there are four constraints on behavior that apply in real space as well as virtual space: laws, the marketplace, norms, and code. They can be appled to establish ways of the protection of information human rights. The most significant of them is code, since the code of the Internet tend to make it autonomous space. If government regulates the human rights by laws, it inevitably results in the threats of personal autonomy and the clash of rights. There is less government can do in virtual space than in real space. Norms are most ideal to protect information human rights autonomically, however, they are questionable in its real effects. The marketplace is doubtful in that dignity and freedom of humane may be exchanged with money on it. Code, such as PICS, P3P, User-based blocking programm, and so on, can most ensure the protection of information human rights, not only without infringing personal autonomy, but also without clashing rights.
