상담위탁 보호처분 처리 실태를 중심으로 본 가정폭력법제도 개선방안

본 논문은 가정폭력범죄의 처벌에 관한 특례법이 가정폭력에 대해 제대로 개입하고 있는가 하는 문제의식에서 출발하여 동법이 규범력을 갖지 못하는 원인을 가부장성이라고 보고, 가정폭력가해자 및 법에 내재되어 영향을 미치는 가부장성을 분석하고 법제도의 개선 방안을 모색하였다. 연구방법으로 1998년부터 2011년까지 서울가정법원에서 한국가정법률상담소에 상담위탁한 보호처분 결정례를 분석하였는데, 분석 결과 가해자들은 폭력행사 원인에서 가부장성의 특성을 나타냈고, 가정폭력범죄로 처벌된 폭력은 주로 신체적 폭력에 집중되었으며, 가정폭력사건 처리과정에서 피해자의 권리는 보장되지 못하였고 공권력은 소극적인 태도를 보이는 등 가부장성이 확인되었다. 이에 가정폭력을 둘러싼 법제도의 가부장성을 개선하기 위한 구체적인 방안을 제시하였다.
Abstract
This paper attempts to evaluate the extent to which the Act on special cases concerning the punishment, etc. of crimes of domestic violence is effectively enforcing the prevention of domestic violence and protection of victims. The paper is premised upon the idea that patriarchal features is the primary cause of the law’s inability to fullyexercise its regulatory power. Therefore, I analyzed patriarchal aspects inherent in this special act and sought methods on the improvement of legal system. According to the analysis of “Entrustment of Counselling” by KOREA LEGAL AID CENTER FOR FAMILY RELATIONS from 1998 to 2011, offenders tend to display patriarchal aspects and the punished crimes centered on physical abuse. During the resolution of these domestic violence cases, the victims’ rights were not guaranteed and the governmental authority remained passive. Therefore, I propose detailed methods to improve of legal system regarding domestic violence.
