「경비업법」 개정을 통한 민간조사 제도 도입의 검토

Abstract

In Korea, private investigation is regulated by 「USE AND PROTECTION OF CREDIT INFORMATION ACT」 but private investigation companies are growing illegally as a messenger office because of limitation of police power and expanding demand of public order by the public. On the other hand, private investigation businesses have been entered into general use as an important area of private security in advanced countries and also the private investigation businesses are introduced to protection of the public's life and property in every OECD-member countries except Korea. Meanwhile, multinational private investigation companies are in the market after Korea joined OCED group in 1996 and a legislation for the private investigation has been attempted to legislate nine times by a member of the National Assembly, Ha, Soon-Bong in 1999 but it have been foundered as interest groups' resistance. By the way, in past cabinet meeting, on march 18, 2014, a private investigator was included to promotion plan for new occupation so a legislation of the private investigation is getting power. The present, legislations are pending a member of the National Assembly, Yoon, Jae-Ok's 「All Amendments Private Security Act」 and a member of the National Assembly, Song, Young-Geun's 「Private Investigation Act」 in the assembly. The present, the predominant view regard private investigation business as a kind of private security so this study attempt to result of legalization questingly. As results of this study, an introduction of private investigation system through amending 「Security Services Industry Act」 shows positively in convenience to management but in character and operation of organization in the private investigation business and an expertise aspect show negatively.
