민간조사제도의 입법화: 경비업법 개정의 실효적 논의

민간조사는 아직 국내에서 입법화되지 않았지만, 외국의 주요 선진국에서는 이미 민간경비의 주요영역으로 일반화되어 있어 우리나라에서도 민간조사제도가 입법화되어 경찰이 개입하기 어려운 곳에서 국민의 재산과 권리를 지키는 역할을 할 것으로 생각한다. 현재 국내에서도 선진국과 같은 민간조사업체의 필요성으로 심부름센터는 증가하고 있지만 이들의 불법행위에 국민의 피해 또한 증가하여 조속한 법적 근거의 설치를 필요로 하고 있다. 이 연구에서는 윤재옥의원의「경비업법전부개정안」과 같이 민간조사업을 민간경비업의 하나로 보는 것에 대한 인식을 탐색적으로 살펴보고자 하였으며, 연구목적을 달성하기 위하여 국내의 대형 보안업체 종사자 470명을 조사대상으로 하였다. 그 결과 ‘매우 부정적’(11.0%), ‘부정적’36.4%), ‘보통’(3.0%), ‘긍정적’(15.0%), ‘매우 긍정적’(38.2%)으로 나타나 부정적 요인과 긍정적 요인이 상존하고 있는 것으로 나타났다. 이 연구목적을 논의한 결과 민간조사업을 민간경비업의 하나로 볼 때 긍정적 효과는 범죄예방효과, 민간경비업의 사회적 인식제고, 민간경비원의 처우 개선 등이었고, 부정적인 요인은 경제적지위에 따른 정보수집 확대, 사생활침해 등이 문제시 되었으며 민간조사와 민간경비의 업무처리 방식의 구조적 차이로 민간조사업을 민간경비업의 하나로 볼 수 없다는 의견도 있었다.
Abstract
Private investigation is still not been enacted in domestic and foreign private security of the major developed countries have already become commonplace in Korea as a major area of research institutions in the private sector is difficult to legislate where the police are involved in the property and rights of the people to keep the role of be considered . Even in developed countries such as the domestic private investigation company is increasing the need to run errands center of the illegal activities , but they also increase the damage of the people requires the installation of swift legal basis to be . In this study, members of the Yun Jae-Ok 「All Amendments Private Security Act」and the private investigation business as a private security awareness up seeing one of the exploratory study was to examine one aspect of the wish of the large national security company employees 470 people examined study. The result is Very Negative(11.0%), Negative(36.4%), Medium(3.0%), Positive (15.0%), Very Positive(38.2%) of the positive factors and negative factors appear the lingering respectively. Purpose of this study, discussed the results of one of the private investigation business when the Civil Guard and Other Protective Services Crime Prevention effect positive effect, Private Guard and Other Protective Services social awareness, and improving the treatment of private security guards and was a negative factor in the economic status of an information collection expanded, Privacy has been infringed upon, such as the problem of private security and private investigation of the structural differences in handling business in a private civil action can not be seen as one of the guard and Other Protective Services had opinion.
