장애인차별금지법과 상충되는 교육 관련 법령 연구

본 연구의 목적은 교육현장에서 장애인에 대한 차별을 예방하고 권리를 보호하기 위해 장애인차별금지법에서 제시하고 있는 내용과 상충되는 교육 관련 법령을 분석하고 상충 내용에 대해 개정･삭제･신설안을 제시하는 것이다. 이를 위해 교육 관련 장애 차별과 관 련된 전문가(법률 전문가, 교육 전문가, 장애 당사자 등) 10인의 델파이 패널을 구성하여 개정･삭제･신설안에 대한 의견을 수렴하였다. 또한 전문가들의 의견에 기초해 내용타당 도비율(Content Validity Ratio)을 계산하여 정량적으로 개정･삭제･신설안의 타당도를 검증하였다. 연구 결과, 영역 1(입학･전학･전입･편입) 4개, 영역 2(교육 관련 프로그램 및 서비스) 5개, 영역 3(정당한 편의) 7개, 영역 4(평가･진단･시험) 5개, 영역 5(기타) 1개에 대한 개정･삭제･신설안을 제시하였다.
Abstract
The purpose of the current study is to investigate education-related legislations which conflict with the Anti-discrimination Disability Act in order to prevent the discrimination against people with disabilities(PWDs) and to improve PWDs’ rights in the field of education. A delphi panel with a total of 10 experts was formed to examine professional perspectives on revisions for conflicting legislations. In addition, the Content Validity Ratios of each revision were calculated in order to quantitatively examine the validity of each revision based on the perspectives. As a result, a total of 22 revisions in 5 domains were proven valid: 4 revisions in the Domain 1(Admission and Transfer), 5 in the Domain 2(Education-related Services and Programs), 7 in the Domain 3(Reasonable Accommodations), 5 in the Domain 4(Evaluation and Assessment), and 1 in the Domain 5(Others).
