장애인차별금지법과 상충되는 고용 관련 법령 연구

연구목적: 본 연구의 목적은 고용 관련 법령 중 장애인차별금지법의 내용과 상충되는 법령을 조사하여 개정안을 제시하는데 있다. 연구방법: 장애인 고용 차별과 관련된 전문가(법률 전문가, 고용 전문가, 장애 당사자 등) 15인의 델파이패널을 구성하여 상충 법령의 개정안을 분석하였다. 또한 전문가들의 의견에 기초해 내용타당도비율(Content Validity Ratio)를 계산하여 정량적으로 개정안의 타당도를 검증하였다. 연구결과: 분석 법령 110개 중 1차 및 2차 델파이조사를 통해 최종적으로 10개 법령에 대한 개정안을 제시하였으며 각 개정안의 개정필요성을 추가하였다. 구체적으로, 장애인을 고용 취약계층에 추가하는 개정안 6개, 정당한 편의 및 직무조정과 관련된 개정안 1개, 직무 · 직종 다양화를 위한 개정안 1개, 장애인 당사자의 정책결정과정 참여를 위한 개정안 2개가 도출되었다. 시사점: 고용 관련 법령의 개정을 통해 실제 고용 현장에서 장애 차별을 최소화하고 장애인이 비차별적인 고용환경에서 일할 수 있는 정책적 · 법적 시사점을 제시하였다.
Abstract
Purpose: The purpose of the current study is to investigate the employment-related legislations conflicting with the Anti-Discrimination Disability Act and to propose revised amendments to the legislations. Method: On the basis of the Delphi Panel with 15 experts from the field of legislation, employment, and disability discrimination, conflicting legislations were examined and analyzed. In addition, through the analysis of the Delphi Panel, the Content Validity Ratios of each legislations were calculated in order to quantitatively investigate the reliability of each amendment. Results: As a result, a total of 10 amendments were finally proposed among 110 legislations through the first and second analyses of Delphi Panel and justification statements of each amendment were suggested. Specifically, 6 legislations related to the introduction of people with disabilities to the employment-vulnerable groups, 1 related to the improvement of the reasonable accommodations and work environment modification, 1 related to the development of job placements and opportunities, and 2 related to participation in employment-related policy decision-making processes are proposed. Implications: By amending the employment-related legislations which are conflicting with the Anti-Discrimination Disability Act, actual discriminations against people with disabilities are minimized in the workplace and the legal foundation is proposed in order to form the anti-discriminatory work environment for people with disabilities.
