일본의 종합법률지원체계와 국선변호인의 관리

우리는 법률구조업무와 국선변호 관리업무를 법무부와 법원에서 각각 관리하고 있다. 그러나 이러한 방식은 법률서비스의 종합적인 제공에 있어서 문제가 있다는 지적이 있으며 새로 도입한 국선전담변호사제도도 특혜의혹에 휩싸여 있다. 대한변협은 해결방안으로 일본의 운영방식을 참고할 필요가 있음을 제안하였다. 일본은 법무성 소관의 일본사법지원센터에서 종합법률지원을 하고 있다. 센터 설립에 있어서 가장 큰 계기는 국선변호인의 확보문제이었고, 국선변호인의 직무 독립성과 전문성의 향상 과제에 대해서는 법무성의 불필요한 관여를 배제시키고 보수산정방식을 개선하여 해결하고 있다. 본고는 일본의 종합법률지원체계의 소개와 관련 과제를 분석한 후 우리 국선변호인 관리주체의 선정문제에 관해 제언한다.
Abstract
We manage civil legal aid at the department of Justice and services related to court-appointed defense counsel(public defenders) at the court. The two systems cause trouble to make an integrated legal service. And newly introduced system of public defenders proves useful to secure lawyers but it is caught up in preferential controversy. Korean Bar Association suggests the Japan Legal Support Center’s operation system as a reference. Japan Legal Support Center is a public corporation established according to the frameworks of an incorporated administrative agencies under Ministry of Justice. To secure many public defenders was a key factor for it’s establishment. And Comprehensive Legal Support Act keeps many rules to exclude any unnecessary concern of Ministry of Justice. This text looks the background(Judicial Network Initiative, the draft revision of Comprehensive Legal Support Act etc) that led for public defenders to ensure independency and professionalism. And it proposes several improvements for our public defender system.
