한국 정부의 원양 불법어업 통제역량과 제도적 영향요인 연구

본 연구는 한국 원양어선들의 불법어업 행위를 해소하기 위한 국가적 통제역량의 필요성에 주목하고 그러한 역량 수준을 높일 수 있는 제도적 요소들의 경험적 분석을 시도하였다. 이를 위해 원양산업 관련 제도를 파악하고, 선행연구들의 도움을 받아 정부의 원양 불법어업 통제역량에 영향을 미칠 것으로 예측되는 제도적 요인들로서 불법어업의 관리수준, 불법어업 제재의 적정성, 어획증명제도의 적정성, 국제협력의 체계성, 이해관계자와의 협력수준을 도출하였다. 분석결과, 응답자들은 정부의 원양 불법어업 관리 및 업무수행은 물론 불법어업에 대한 제재 조치, 불법어업 방지를 위한 국내외 협력체계의 구축, 그리고 이해관계자들의 관련 법 및 규정에 대한 협력적 이행 수준들이 적절할수록 한국 정부의 불법어업 통제역량이 효과적이라고 판단하였다. 이에 첫째, 원양어업 허가 강화 등, 둘째, 제재 수준의 검토 등, 셋째, 국제협력 체계 강화, 넷째, 민관 협력체계 구성과 한국 원양업계의 국제규범의 이해도 제고를 위한 제도 개선을 제언하였다
Abstract
The objective of this study is to analyze institutional factors that may influence the South Korean government’s capacity to control illegal, unreported, and unregulated (IUU) fishing by Korean distant water fishing vessels in order to identify the shortcomings in the national implementation of regulations adopted by international fisheries organizations to prevent, deter and eliminate IUU fishing, thereby presenting directions and suggestions for further improvements. The survey was administered to 124 individuals in three different groups: officials of the Ministry of Oceans and Fisheries, its subsidiary agencies, industry stakeholders. The empirical analysis revealed that four out of the five key factors (i.e., IUU control, sanctions, international cooperation, public-private cooperation) may have significant impacts upon the government’s capacity to control IUU fishing. As a result, this study suggests that, in order for the government to enhance its capacity to control IUU fishing: (i) the roles of the Fisheries Monitoring Center should be further strengthened; (ii) the types of infringements and relevant sanctions should be realigned; (iii) governance networks with the international community should be expanded; (iv) a public-private cooperation mechanism should be established to enhance the understanding of the industry about international rules in the fight against IUU fishing.
