불법어업 예방 및 근절을 위한 한국의 처벌 제도 개선 연구

본 연구에서는 불법어업을 억제 내지 예방하기 위한 여러 수단 가운데 생산단계에서 불법어업으로 인한 이익을 환수하기 위한 벌금의 상향조정, 불법어업 협정의 체결, 그리고 담보금의 용도제한 등을 제시하고 있다. 그리고 EEZ 법의 법제 개선 방안에 대해서도 연구를 했다. 아울러 한국정부는 신속하게 외국 선박의 불법어업과 한국 선박의 불법어업을 예방하고 억제할 수 있는 제도 개선방안에 대하여 연구를 했다. 한국은 러시아와 불법어업 협정을 체결한 경험이 있다. 한국정부는 동해안 지역경제를 이유로 반대를 했지만 결국 협정은 체결되었다. 러시아 대게의 수입은 계속 증가되고 있고 수입 단가도 계속 상승하고 있다. 불법어업을 억제 및 예방하기 위한 제도 개선이 처음에는 어려울 수 있지만 결국 세계 수산자원을 보호할 수 있고, 어업인 및 종사자 모두에게 유익하게 될 것으로 보인다.
Abstract
Korean coast guards have detained over 450 Chinese fishing vessels every year for allegedly illegal fishing in a Korean exclusive economic zone since 2007. The foreign fishermen can be fined up to ￦200,000,000, while their boat and fish also can be forfeited. Korea amended its law to deter recurring IUU by foreign violater including Chinese fishing vessels. This paper finds that the current Korean IUU penal regime is not enough of a disincentive to discontinue profitable illegal activity. The Korean punishment regime does not appear to give Korean government the mandatory seizure of the illegal catch or its proceeds. The current Korean bond system against seized IUU vessel also is insufficient to deter Chinese fishing vessels from violating Korean management measures. This paper suggest to amend the current fishing regime which is applicable both foreign and Korean fishing vessels by raising maximum fine limit and mandatory forfeiture of the illegal catch or its proceeds. It is also necessary to harmonize Korean fishing law applicable to the Korean flag fishing vessels engaging in fishing activities that violate conservation and management measures required under an international fishery management agreement.
