특별법 중심 입법이 법체계에 미친 영향: 법률간 인용에 대한 종단 네트워크 분석을 중심으로

초록

이 논문에서는 특별법 중심 입법의 누적이 법체계에 미친 영향을 네트워크 분석으로 검토했다. 특별법은 특정 사안에 대한 개별적･구체적 규율을 위한 법률로서, 기존 행정절차및 규제를 특별히 면제하는 ‘특례’ 및 ‘인･허가 의제’를 포함한 경우가 많다. 법제명상 특별법과 특례 및 인･허가 의제 규정을 중심으로 법률간 인용 구조의 73년간 변화를 분석했다. 한국 법체계는 제17대 국회부터 제19대 국회까지 빠른 네트워크 성장을 보여주었다. 이 기간 동안 국토･교통 분야 규제의 특례를 정하는 특별법을 대량으로 입법하여 관련 법들로 긴밀하게 연결된 법률의 군집이 빠르게 성장한 것을 발견했다. 이로써 타법에서 가장 많이 인용되는 법률은 2009년부터 「민법」에서 「국토의 계획 및 이용에 관한 법률」로 변하였으며, 피인용수는 네트워크 내에서의 저명성을 나타내므로 이는 한국 법체계의 상당한 변화를 시사한다. 특별법 중심의 입법 경향은 제도의 복잡성 등 비용을 발생시키고 있으므로, 대안적 입법정책을 모색할 필요가 있다.

Abstract

In this paper, the effect of repeated enactment of special laws on the legal system was reviewed through network analysis. Special laws are laws that establish specific rules for specific issues, and often include 'exemptions' and 'deemed approval' provisions that specifically exempt existing administrative procedures and regulations. The long-term changes in the citation structure between laws were analyzed, focusing on special laws. The Korean legal system showed rapid network growth from the 17th National Assembly to the 19th National Assembly. During this period, special laws were legislated in large quantities to exempt regulations in the fields of land, transportation, and construction. The result is a rapidly growing cluster of closely interconnected laws in land, transport and construction. The most frequently cited law has changed from the Civil Act to the National Land Planning and Utilization Act in 2009. Efforts to legislate less special laws are needed because too many special laws incur costs such as complexity of the legal system.
