건축 민원 분석을 통한 건축법제 개선방안 연구

본 연구는 2019년부터 2021년까지 국토교통부 건축정책과에 접수된 총 28,237건의 민원을 텍스트마이닝 기법으로 분석하여 건축 관련 법적 문제점을 파악하고 개선방안을 제시한 것이다. 분석 결과, 건축 규모 기준, 건축물 용도 분류, 도로 관련 건축 허가 기준, 건축 허가 방법 및 절차, 가설건축물 요건 및 허가기준, 위반건축물에 대한 조치, 공사 감리자 자격기준 및 업무와 관련된 민원이 주로 발생하는 것으로 나타났다. 이를 바탕으로 「건축법」의 규정 미비점을 검토하여, 다락, 발코니, 부속건축물에 대한 기준 구체화, 용도 분류 체계 개선 및 용도 변경 절차 유연화, 사실상 도로에 대한 기준 구체화, 건축 허가 방법 및 절차 세분화, 가설건축물 유형 구분 기준 명료화, 공사 감리자 규정 취지 명확화 등의 개선 방안을 제안하였다. 본 연구는 대량의 민원 데이터를 분석하여 건축 분야의 주요 이슈를 도출하고, 법령상의 문제점을 체계적으로 식별함으로써 효율적이고 실효성 있는 입안 및 정책 수립에 기여할 수 있는 가능성을 제시했다는 점에서 의의를 가진다.
Abstract
This study analyzed 28,237 complaints submitted to the Architectural Policy Division of the Ministry of Land, Infrastructure, and Transport from 2019 to 2021 using text mining techniques to identify legal issues related to building activities and propose improvement measures. The analysis revealed frequent complaints regarding building size standards, building use classification, road-related building permit criteria, building permit methods and procedures, requirements and permit standards for temporary buildings, measures against illegal buildings, and qualifications and duties of construction supervisors. Based on these findings, the study reviewed deficiencies in the current "Building Act" and proposed improvement measures, including: - Clarification of standards for attics, balconies, and accessory buildings, - Improvement of use classification systems and flexibility in use change procedures, - Clarification and segmentation of criteria for de facto roads, - Clarification and detailing of building permit methods and procedures, - Refinement of categorization standards for temporary buildings, and - Clarification of the intent and purpose behind regulations for construction supervisors. This study highlights the potential of large-scale complaint data analysis to identify key issues and legislative deficiencies in the construction sector. By systematically addressing these gaps, the findings contribute to the possibility of effective and practical policy-making, advancing administrative efficiency and regulatory precision.
