Abstract

The war between Russia and Ukraine is evolving into a conflict between Russia and the West, along with the United States, Australia, and other countries, providing weapons to Ukraine. In 2023, President Yoon Suk-yeol pledged arms support for Ukraine. Russia regarded South Korea’s arms support as an intervention in the conflict or an anti-Russian hostile act, while China remarked that South Korea had fully sided with NATO. Domestically, some argued that before providing arms to nations involved in conflicts, South Korea should seek approval from the National Assembly. This led to proposals for amendments to the Defense Acquisition Program Act and the Act on the Management of Military Supplies in the 21st National Assembly. To assess the unconstitutionality of direct or indirect weapons support to countries involved in conflict, this study examines the international legal implications of arms support for Ukraine and patterns in the involvement of major countries’ legislatures in providing such support for Ukraine. This study finds that South Korea’s legal system has inconsistencies regarding the need for National Assembly approval for providing weapons support to foreign countries. Additionally, compared with the responses of other major countries’ legislatures, a lack of balance was also observed, which risks sending unintended negative signals to the international community. Hence, careful consideration is necessary in lawmaking.
