Abstract
As cases of human rights violations of ‘forced hospitalization,’ which expressed ‘hospitalization by a person with a duty of care,’ became a social debate, the Mental Health Act, first enacted in 1995, was amended wholly in 2016 to the “Act On The Improvement Of Mental Health And The Support For Welfare Services For Mental Patients.” This study qualitatively analyzed the determinants of the whole amendment by analyzing streams of organizational, symbolic, economic, and scientific politics based on Expanded Kingdon’s multiple stream theory framework. As a result, the legal and social welfare academia supported the protection of human rights for mental patients, and a human rights discourse was formed that gave the Mental Health Act an anti-human rights image. The government, including the National Human Rights Commission, and legal academia have opposed forced hospitalization and accumulated scientific evidence for promoting human rights and welfare. The medical community, which led the treatment and protection discourse, was opposed to it concerning economic losses due to the revision of the law; however, it was unable to turn over those streams. Recognizing the prevailing streams of valuing the human rights of the mentally disabled, the government and the National Assembly decided to the whole amendment.
