Abstract

Because of such a distinctiveness of the SW invention, the examination guideline for the patent eligibility and the inventiveness of the SW invention in US is influenced by, beyond the regulation of law, the amount of technological development (innovation), Pro Patent policy, Patent Troll problem, Open Software etc. the national economy and policy, and it is being handled to the very important issue most affecting to the SW industrial development. Especially in the explosively increased SW invention after State Street Bank Judgement on 1998, the patent eligibility of the SW invention has been very strictly decided owing to the influence of Alice Judgement on 2014. However the various interpretation in CAFC on Alice Test suggested in Alice Judgement, the continuously changed examination guideline of the USPTO, the association between the interpretation of Article 101 of the Patent Law which explains the definition of invention and the inventiveness has become an issue. In relation therewith, there is a revision of the Patent Law going on etc., it would be in a great confusion on the patent eligibility creation of the SW invention and needed to be greatly noticed. And upon analyzing Decisions and Judgements relating to the patent eligibility of the SW invention by Alice Test, there is many cases of deciding by applying the conception of inventiveness to the patent eligibility decision. Such a reason is to be an issue in relation with the interpretation of Article 101 deciding the patent eligibility. That is, it would be discussed that from the expression called to "any new and useful" in Article 101, the judgement law of the inventiveness is applied to the patent eligibility decision. In relation therewith, in the Senate Judiciary Subcommittee on Intellectual Property, there is a public hearing for revision of the US Patent Law, and an argument in that the patent eligibility should be decided by dividing the patent eligibility and the inventiveness has been raised even in the industrial world. It is needed to monitor the policy and the trend of revising the Patent Law in US for enforcing the patent protection of such an SW invention.
