스칸디나비아 국가의 집단소송제도와 그 시사점

최근 일련의 사건들로 인해 사회 전체적으로는 중요한 권리이나 개개인에게 흩어져 있어 효율적인 보호를 받지 못하는 권리를 보호하기 위한 수단으로서의 집단소송제도에 대한 관심이 크게 증가하였다. 이 글에서는 현재 국회에 제출된 집단소송 관련 법안들의 내용을 살펴본 후 스칸디나비아 국가의 집단소송제도에 대해 살펴보았다. 그 후 스칸디나비아 국가의 집단소송제도가 우리에게 어떤 시사점을 줄 수 있는지에 대해 비교법적 관점에서 함께 고찰하였다.
Abstract
There has been increasing interest in recent years in class action. This article is intended to examine bill of class action in Korea and class action in Scandinavian countries. After a examination, this article conducts a comparative legal analysis to examine implications of Scandinavian class action. This article also suggests ways to improve our system of class action in a more effective way.
