본 연구의 목적은 한국의 선거법체계가 숙의민주주의에 부합은커녕 ‘최소주의’로 정의한 ‘선거민주주의’의 요건에도 미달된다는 것을 문제 제기하고, 개선의 대안으로 비용중심의 선거규제를 제시하는 데 있다. 숙의민주주의의 선거과정에서 가장 중요한 것은 시민(유권자)과 후보자 간 혹은 시민과 정당 간의 의사소통이다. 영국, 미국 등 선진국의 경험처럼, 우리도 민주화의 경험과 시대상황의 변화에 따라 선거운동방식규제에서 비용규제로의 전환이 필요하다는 점을 이론적으로 논의한다. 그리고 그 규범적 필요성을 실현하는 데 제기되는 여러 가지 쟁점사항, 즉 현행 선거법체제의 문제점, 정치활동과 공정성의 조화, 바람직한 규제의 방향, 전환 시 예상되는 문제점 등을 살펴보고 해법의 실마리를 찾는다. 비용규제로 전환하는 데 있어 우선 검토해야 할 사항은 다음과 같다. 선거운동의 방법규제를 비용규제로 전환하려고 하는 경우에도 단계적인 로드맵과 비전하에 치밀하고 점진적으로 진행해야 한다. 또한 공익적 시민단체, 정치팬클럽, 자발적 봉사조직은 장단기적으로 미국의 정치활동위원회(PAC)처럼, 후원회조직을 조직하여 후보자와 정당에게 정치자금을 후원하거나 정책홍보활동을 할 수 있도록 보장할 필요가 있다. 당연히 후원회 조직의 수입과 지출사항은 엄격하게 보고하고 감사받도록 해야 한다. 본론에서는 비용규제의 구체적인 내용을 다룬다.
Abstract
The purpose of this study is to suggest that the election law system of Korea falls short of the requirement of 'electoral democracy' defined as 'minimalism' rather than the transition to deliberative democracy, and to suggest cost-based election regulation as an alternative. The most important thing in the electoral process of deliberative democracy is communication between citizens (voters) and candidates or between citizens and political parties. In this study, we will theoretically discuss the need to change the regime of election campaign method to the regulation of the cost according to the experience of democratization and changes in the situation of the time, like the UK and the US. And we will examine the various issues raised in the realization of the normative necessity like the problems of the current election law system, the harmonization of political activities and fairness, the direction of desirable regulation, and the anticipated problems in transition, and try to find a clue to the solution. The following items should be considered in the transition to cost regulation. First, even if we try to convert election campaign regulation into election cost regulation, we must proceed in a detailed and progressive manner under a step-by-step road map and vision. Second, there is a need to guarantee that public-interest NGOs, political fan clubs, voluntary service organizations organize support organizations such as the US PAC in the short and long term to support political funds and publicity activities for candidates and political parties. Of course, the income and expenditure of the sponsoring organization should be strictly reported and audited. And this paper of main text deals with the specific contents of cost regulation.
