본 연구는 한국의 수평적 문책성을 법제적 제도 설계와 실제적 작동 성과라는 두 차원에서 평가하고, 그 결과를 제3파 민주화 국가들과의 비교 맥락 속에 위치시킨다. 분석 결과, 한국 민주주의의 수평적 문책성은 법제적으로 과도한 제도적 편향 없이 입법부와 사법부가 행정부를 견제하도록 설계된, 비교적 최적화된 권력분립·견제균형 구조를 구축하고 있음을 보여준다. 그러나 동시에 한국의 수평적 문책성에는 제도 설계와 실제 성과 사이에 위험한 괴리가 존재함도 확인된다. 한국 민주주의에서 반복되어 온 퇴행과 회복은 이러한 설계–성과 간 긴장이 정치 과정에서 표출된 한 양상으로 이해할 수 있다. 더 나아가 본 연구는 한국 민주주의의 퇴행과 회복을 동시에 설명하는 데 ‘민주주의 진동’ 개념이 유용하다고 주장한다. 즉 선거 정당성을 헌정적 제약보다 우선시하는 진보 성향 대통령이 포퓰리즘적 과잉으로 기울 때, 혹은 헌정적 제약을 선거 정당성보다 우선시하는 보수 성향 대통령이 과두적 과잉으로 기울 때, 민주주의는 한쪽으로 급격히 쏠렸다가 반동을 겪는 방식으로 불안정하게 진동한다.
Abstract
This study evaluates South Korea’s horizontal accountability by distinguishing between its de jure institutional design and its de facto performance, and situates the findings within a comparative context of third-wave democratizers. The analysis shows that, at the level of formal institutions, South Korea has constructed a relatively well-calibrated separation-of-powers and checks-and-balances architecture in which the legislature and the judiciary are designed to constrain the executive without excessive institutional bias. At the same time, the study finds a dangerous gap between institutional design and actual performance. The recurrent pattern of democratic backsliding and restoration in South Korea can be understood as one manifestation of the tension between de jure arrangements and de facto outcomes. Building on this, the study argues that the concept of “democratic careening” is useful for explaining both regression and recovery. Specifically, democratic careening tends to occur when a progressive president prioritizes electoral legitimacy over constitutional constraints and veers into populist excess, or when a conservative president prioritizes constitutional constraints over electoral legitimacy and tilts toward oligarchic excess—producing an unstable dynamic of sharp partisan overreach followed by backlash and partial restoration.
