자국민의 건강보호를 위한 기술규정 조치의 국제통상법적 쟁점에 관한 소고 : 미국-인도네시아 정향담배 사건을 중심으로
A Study on Int’l Trade Legal Issues in Technical Regulations for Protecting Human Health: Focusing on the WTO US- Clove Cigarettes Case

본고는 정향 담배 수입금지에 대한 미국과 인도네시아간의 TBT협정 사례를 통해 청소년의 흡연 예방 등과 같이 자국민의 건강보호 등을 위한 정당한 목적을 수행하기 위한 기술규정 조치가 WTO 규정에 위반되지 않고 유효하게 유지되기 위해서는 TBT협정의 주요 조항들이 어떻게 해석되어져야 하고 적용되어져야 하는지를 살펴보았다. TBT협정은 그 적용대상이 GATT협정과 다르고, GATT협정에서의 ‘의무위반-일반적 예외조항’의 구조가 TBT협정상에 존재하지 않기 때문에, GATT협정의 접근방식이 그대로 TBT협정에 적용되어져서는 아니 된다. TBT협정의 내국민대우 원칙을 적용함에 있어서는 GATT협정과는 달리 ‘정당한 목적’의 고려가 중요한 역할을 담당해야 한다. 즉 동종 상품을 구별하는 기준 및 차별적 대우 존재여부를 판단함에 있어, 기술규정이 채택되게 된 목적을 고려한다면 TBT협정을 통해 이루고자 하는 회원국들의 권리와 의무간의 균형을 맞춰나갈 수 있을 것이다. 또한 불필요한 무역장애금지원칙을 논할 때에도 제시된 각 수단들의 ‘목표달성 기여 정도’를 당 회원국이 처한 기술, 경제적 사항 및 여러 가지 사안들을 모두 비교형량하여 필요성의 정도를 결정하게 된다면 TBT협정의 권리와 의무사이의 형평성을 유지할 수 있을 것이다. 마지막으로 새로운 기술규정 공표 및 발효사이의 합리적인 기간 공백을 결정함에 있어, 특정 기간을 미리 정해놓기 보다는 여러 제반사항들을 고려하여 사안별로, 그리고 회원국 수준별로 결정하여야 할 것이다. 이렇게 될 때, 정당한 목적달성을 위한 회원국의 기술규정 조치가 TBT협정 규범 안에서 유효하게 보호받을 수 있을 것이며 이는 결국 회원국의 권리와 의무, 나아가 자국민의 건강보호(넓은 범주로는 환경보호)와 자유무역 증진이라는 두 가치의 이익의 균형을 극대화할 수 있을 것이다.
Abstract
This article focuses on the recent TBT-related case, US-Clove Cigarettes between the USA and Indonesia to determine how main provisions of the TBT Agreement should be read in order to maintain the sensible balance between the rights and obligations of the Member states. Although rules for trade in goods under the GATT have been well-established, it had been uncertain whether a different approach was required for technical regulations, where Member states adopt measures to pursue legitimate regulatory objectives such as health, safety, or environmental protection. Since the objects of two agreements are different, and there is no “obligation- exception” provision under the TBT, its provisions need to be approached differently than those of the GATT. In this sense, regulatory objectives must be taken into account to the extent that they are relevant to the determination of likeness between the products, and of less favourable treatment under the national treatment. When we decide whether technical regulations cause trade restrictions than necessary to fulfill a legitimate objective, we need to compare the extent how much possible alternative measures contribute in the light of the nature of the risks at issue. In addition, ‘reasonable interval’ must be calculated by taking into account of financial and technical factors situated in the Member state rather than by pointing the certain amount of time.
