WTO/TBT협정 제2.2조의 해석에 관한 연구 - 사례를 중심으로 -

WTO회원국들은 인간, 동물 , 식물의 생명 또는 건강, 국가안보상의 이유 또는 환경의 보호와 같은 정당한 목적을 달성하기 위해 필요한 조치라면 국내법으로 입안할 수 있고, 이러한 회원국의 자치권과 자유무역 증진이라는 WTO이념간의 적절한 균형 유지는 상당히 중요하다. 이를 위해 TBT협정 제2.2조의 정당한 목적의 고려는 무역증진이라는 이념 하에서 각국의 자치권을 원용할 수 있는 적절한 균형을 이룰 수 있을 것이다. 하지만 WTO 회원국이 자국민의 건강 또는 환경보호 등과 같은 목적을 추구함에 있어 기술규정을 통한 자치권 행사는 회원국의 권리와 의무 간에 충돌을 야기할 수 있다. 그 동안 TBT협정에 대한 분쟁해결기구(Dispute Settlement Body, 이하 DSB)의 제한적인 인용으로 그 중요성을 인정받지 못하였지만, 최근 DSB의 유의미한 판례들은 TBT협정의 중요성을 상기시키고 있다. 이에 본 논문에서는 미국-Tuna II, 미국-정향담배 그리고 US-COOL 사건과 관련하여 TBT 제2.2조의 해석 즉, 해당 조치의 정당한 목적, 정당한 목적의 달성을 위한 해당 조치의 기여도, 해당 조치의 무역-제한성 그리고 해당 사안에 있어 위험의 본질과 해당 조치를 통해 해당 회원국이 추구한 목적의 비준수로부터 야기될 결과의 중대성을 해석함으로써 무역 증진과 회원국의 자치권 간의 균형적인 발전방향을 살펴봄으로써 TBT협정 제2.2조의 정당한 목적에 대한 해석기준을 마련하고자 하였다.
Abstract
The preamble of the Agreement on Technical Barriers to Trade (TBT Agreement) shows that ‘no country should be prevented from taking measures necessary to ensure the quality of its exports, or for the protection of human, animal or plant life or health, of the environment, or for the prevention ... with the provisions of this Agreement;’. Through multilateralism and proliferation of regionalism, the world trade system led to positive effects for the vitalization of free trade with tariff reductions. However, increases of non-tariff barriers such as member countries different labelling, recognition and safety standards for the protection of their own countries industries have caused conflicts between member country’s rights and obligations to use their autonomy for the protection of human, animal or plant life or health, of the environment. Even though the TBT Agreement is meaningful in the world trade system, it has limited the WTO disputes related to the TBT Agreement. However, there are three cases interpreted by the agreement in 2012 and through many previous studies examined about the three cases so this paper limits the scope to only Article 2.2. To clarify the points, firstly this paper analyses the background of the WTO/TBT agreement. secondly, examines the three cases adopted from the WTO/DSU under the TBT agreement Article 2.2 and lastly, the possibility of harmonization between the promotion of trade and member’s autonomy and the requirements.
