우리 사회의 마약류중독자들이 점차 늘어나고 있는데 기존의 처벌과 치료 시스템만으로는 마약류사범을 제대로 치료하는데 한계가 있으며 특히 마약류중독의 특징으로 인한 높은 재범률로 인하여 재활의 필요성이 대두되고 있다는 점을 염두에 두고 교정과 사회복지의 연결을 통한 한국형 약물법원 모델을 개발하고자 한다. 이를 위해 교정과 사회복지의 구체적인 연결점을 찾고 실천적인 협력방안을 모색하고자 한다. 이를 위해서는 수사단계나 기소단계부터 약물법원 참가자들을 확인하여 초기 개입할 수 있는 약물법원과 같은 시스템과 인력이 필요하다. 마약류중독자의 재범위험성을 측정하여 이들에게 범죄에 대한 위험요인을 조기에 확인하고 보호를 제공하는데 일정조건과 교육을 갖춘 사회복지사를 선별하는 것이 적당할 것이다. 사법처리과정에 처음으로 접하는 지점에서부터 종료되는 시점까지 사회복지적 개입이 행해지기 위해서는 사회복지분야에서 마약류사범을 어디로 분류해야 할지 정확한 기준이 있어야 할 것이다. 또한 민간기관이 중심이 되어 지역사회와 연계하는 지역사회중심 사례관리가 이루어져야 한다. 이를 위해서는 교정기관과 민간기관의 업무협약을 통해서 교환훈련, 공동평가, 공동계획, 정보공유, 협력회의 등을 가져야 할 것이다. 그리고 이러한 협력을 문서화하는 것도 필요할 것이다. 마약류중독자의 치료․보호업무에 관련된 기관들 간에 원활한 치료보호의 집행을 위해서는 치료보호의 집행계획, 집행방법 그리고 업무협조 등에 관한 구체적 사항을 논의할 협의체가 만들어져야 한다.
Abstract
As the number of drug addicts in our society is increasing, the existing punishment and treatment system alone has limitations in properly treating narcotics crime due to high recidivism and due to characteristics of drug addiction especially in view of the need for rehabilitation. We want to develop a Korean model of drug court as a bridge between Correction and Social Welfare. To this end, we will seek concrete linkages between correction and social welfare and seek practical cooperation. We requires the system such as drug courts and personnel that can identify drug court offenders and intervene early in the investigation or prosecution phase. It would be appropriate to select social workers with certain conditions and education. In order to engage in social welfare interventions from the point of first contact to the end of the judicial process, there must be precise criteria on where to classify drug related offenders in the social welfare field. In addition, community-based case management linked to the local community should be carried out by private institutions. To do this, cross-training, joint assessment, joint planning, information sharing and staff meeting should be held. Agreement describing the service relationship should be written down in detail. A consultative body should be created to discuss specific details of the implementation, planning, and coordination of treatment care.
