마약류사범이 처벌과 재발이라는 악순환구조가 반복적으로 지속되어 오는 것은 마약류사범중 상당수는 치료받아야할 환자라는 점에서 현재처럼 형사처벌중심의 시스템은 그 한계가 있기 때문이다. 그리고 마약류사범에 대한 국가의 치료적 개입 시스템이 제대로 작용하지 못하고 있기 때문이다. 이를 개선하기 위해서, 미국의 약물법원을 우리의 체계에 수용하기 위한 방안을 검토해 보았다. 현재 미국처럼 약물법원이라는 특수법원을 우리 법체계에서 인정하려면 헌법이나 형사소송법을 개정하여야 하는 문제가 발생할 수 있는데 가칭「약물재판의 운용에 관한 법률」(이하 ‘약물재판법’이라 함)을 제정한다면 특수법원의 형태가 아니라 형사재판의 한 유형으로서 약물재판을 진행할 수 있게 된다. 약물재판법의 약물법원은 검찰단계에서부터 지역사회자원인 의사, 간호사, 약사, 사회복지사 등이 개입을 하게 되어 일정 시기마다 약물검사를 통해 지도 감독을 수행하며 재판이 종결된 이후에도 다양한 치료기관들과 지역사회가 연계하여 활동을 하게 되는 한국형 약물법원이라고 할 수 있다. 약물재판법에는 참가자의 ‘적격성 기준’을 마련하여야 할 것이다. 그리고 이 기준에 따른 참가자의 적격성 판단주체는 수사단계와 기소단계에서는 검사, 재판단계와 판결선고 단계에서는 판사가 참가자를 결정하여야 할 것이다. 검사와 판사가 이를 결정함에 있어서는 정신과의사, 약물전문가 등과의 협력관계가 필수적이다. 약물재판법에서는 전문적인 인력의 확보와 협력적인 약물법원의 구조에 관한 내용이 포함되어야 한다. 현재로서는 법관이 총체적인 감독자가 되는 것이 전문가 및 단체들과 협조관계를 유지하면서 지속적인 사법관여를 할 수 있는 최선의 방법일 것이다. 마약류사범의 다양한 욕구와 중독 수준 및 환경에 따른 프로그램의 기준을 마련하여 전국 어느 기관에서나 동일한 수준의 프로그램을 운영하도록 할 필요가 있다. 최소한 각 프로그램의 목표와 적용대상, 선정기준, 배제기준, 프로그램의 회기, 프로그램 진행기간, 위반시 처리방법 정도는 조속히 표준화되어야 할 것이다.
Abstract
I analyzed problems of current drug related offenders punishment and treatment system. Although Drug related offenders are patients to be treated, they are not treated but punished in current criminal justice system. Because the patients to be treated were punished, they return to drug use and criminal activity after release from prison. Professionalism and diversity of national intervention are lack and the control tower to supervise all process in the treatment for drug related offenders. There are no linkages between the court and service providers. To solve the problems, Korean Drug Courts Act should be made. In Korean Drug Courts, the judgea should supervise all process. A successful drug court and ultimately successful outcomes for offenders depends on collaboration between the court, treatment providers, other social services and community organizations.
