Abstract

Islamic finance has become increasingly popular in the international financial system. One of the countries which is the most responsible for the expansion and popularity of the Islamic finance is Malaysia. Malaysia is the largest Islamic financial hub in Asia-Pacific owing to the strong support for its government, industry and community. The milestones for the official introduction of Islamic finance in that country were set out on July 5, 1982 when the National Steering Committee on Islamic Banking came out with recommendation which were submitted to its government as the following in part: “An Islamic bank whose operations are in accordance with the Sharia principles should be established.” Also under the new banking act, Islamic Banking Act 1983, the supervision and administration of this Act shall be the responsibility of the Central Bank of Malaysia, and Islamic banks shall establish their own Sharia supervisory boards whose function is to ensure that the operations of Islamic banks are in accordance with Sharia law. Furthermore, the new Central Bank of Malaysian Act 2009 (CBMA) strengthened the role of the central Sharia Advisory Council (SAC) of Bank Negar Malaysia. Thus, Malaysia introduced two-tier Sharia committees consisting of two levels of Sharia advisory/supervisory functions, that is, Sharia committee at the institutional level and SAC at the national level. Importantly, enactment of CBMA, in particular sessions 56 and 57 of the Act, strengthened the role of the SAC in resolving Sharia issues referred to it by the court or arbitrator. The effectiveness and workability of this model has proved to be work well. Through this paper, I propose to provide its basic theory of two-tier Sharia committees to our government and companies which are related to Malaysia Islamic finance as well as introducing Islamic finance theory in Korea legal industries.
