초록

이 논문은 최근 관심이 높아지고 있는 이슬람금융을 법적 측면에서 검토하는 것을 목적으로 특히 외국에서의 이슬람금융을 지원하는 법제 동향을 고찰하고 한국에서 이슬람금융을 활용하고자 하는 경우 예상되는 법적 장애들을 추출하고 그 개선방안을 모색하였다. 다른 나라와 달리 국내에서 금융회사가 이슬람금융을 활용하고자 하는 경우 현행 금융법제하에서는 다양한 법적 장애에 직면한다. 반면, 우리와 달리 이웃국가인 말레지이아, 인도네시아, 싱가포르등에서는 법제와 세제상의 지원을 통해 이슬람금융이 이용될 있도록 직간접적으로 지원 및 인프라 마련에 적극적인 태도를 보이고 있다. 비록 금융위기 이후 이슬람금융회사의 성과는 다소 감소되는 경향이 있기는 하지만 이슬람금융에 대한 관심은 위기 이전에 비해 더 높아졌다고 할 수 있다. 이러한 점을 인식하여 이 논문에서는 이슬람금융의 발전 동력과 요인을 확인하고, 이슬람금융의 성격과 유형을 전통적인 금융상품과 비교 분석하며, 국내 금융법제하에서는 이슬람금융을 이용하거나 국내 금융회사가 외국에서 이슬람금융을 영위하는 경우 어떠한 법적 장애가 있는지 조사하였다. 그 결과 국내 금융회사의 사업모델 확대 및 일반회사의 자금조달 증대를 위하여 금융법제 정비가 필요함을 제안하였다. 이를 위하여 이 논문에서는 5개의 장으로 구성, 다음과 같은 내용을 담고 있다. 우선 이슬람금융이 친숙하지 않음을 인식하고 그 내용을 알 수 있도록 이슬람금융의 성격과 본질을 소개하고, 이후 이웃국가를 포함한 외국(미국, 영국, 싱가포르, 호주)에서의 이슬람금융 지원법제의 동향을 자세히 소개하였다. 이어 국내에서 이슬람금융을 영위하는데 우선적 장애로 꼽히는 법적 이슈(금융법과 세법)들을 선별하여 분석, 검토하였다. 마지막으로 이슬람금융을 국내에서 활용할 수 있는 법제로의 정비를 제안하였다.
