초록
보험사기방지 특별법이 제정되었음에도 불구하고, 보험사기가 지속적으로 증가하자 보험사기의 예비죄를 규정하고 있는 독일 형법 제265조(보험남용)에 많은 관심을 보이고 있다. 보험사기방지 특별법 제정 이전에도 독일 형법상 보험남용과 같은 예비죄를 규정해야 한다는 주장이 전혀 없었던 것은 아니지만, 어렵게 제정된 보험사기방지 특별법이 새로운 규정이 없는 법률이라는 비판과 함께 독일 형법상 보험남용이 과거보다 더 많은 주목을 받는 것으로 보인다. 독일과 같이 보험사기의 예비죄 규정을 신설하자는 주장의 핵심은 보험사기의 예방을 강조하면서, 보험금 청구 후에 이루어지는 보험사기 조사에서는 대부분의 증거가 이미 소멸하거나 훼손되었을 가능성이 크기 때문에, 수사기관의 범죄 입증이 어렵고, 따라서 보험사기 여부를 사전에 조사하는 것이 중요하다는 점을 강조하고 있다. 그러나 독일 형법상 보험남용은 보험금 청구 이전에 보험사기를 수사하여 예비단계에서부터 처벌할 수 있는 규정이 아니다. 독일 형법상 보험남용은 보험금 청구가 독일 형법 제263조를 충족시키지 못하거나, 중지미수에 따라 죄책이 면제된 상황에서 다시 책임을 물어 보험사기의 예비행위를 처벌하므로, 이를 실질적인 보험사기의 예비죄라고 보기는 어렵다. 독일 형법 제265조는 입법 당시 국제적으로 조직된 자동차 밀수 사건이 급격히 증가하는 특수한 상황으로 인하여 제6차 형사법개정의 마지막 단계에서 급히 포함되었다. 그러므로 해당 조항은 충분한 검토와 논의 기간을 거치지 않고 급조된 법률이라는 비판으로부터 자유롭지 못하다. 입법의 주요 동기였던 전문 자동차 밀수범에 대한 처벌에 있어서도 형법 제265조는 적용은 일관되게 실패하고 있다. 현재 독일에서는 해당 조항의 실질적인 중요성을 인정하는 학자가 거의 없으며, 폐지를 주장하는 의견이 주를 이루고 있다.
Abstract
Despite the enactment of the Special Act on Prevention of Insurance Fraud, there is a growing interest in Section 265 of the German Penal Code (insurance fraud), which stipulates the preliminary crime of insurance fraud, as insurance fraud continues to increase. Of course, even before the enactment of the Special Act on Prevention of Insurance Fraud, there were arguments that preliminary crimes, such as insurance fraud under the German Penal Code, should be stipulated. However, with the criticism that the hard-won Special Act on Prevention of Insurance Fraud is a law with no new provisions in its actual content, the insurance fraud under the German Penal Code seems to receive more attention than before. The core of the argument for the introduction of a provision on the preliminary crime of insurance fraud, like in Germany, is to emphasize the prevention of insurance fraud and the importance of investigating insurance fraud in advance, as most of the evidence is likely to have already been destroyed or damaged in the investigation of insurance fraud after the claim, making it difficult for the investigative authorities to prove the crime. However, insurance fraud under the German Penal Code is not a provision that can investigate insurance fraud before the claim and punish insurance fraud from the preparatory stage, unlike the argument for the introduction of a provision on the preliminary crime of insurance fraud. Section 265 of the Penal Code was hastily included at the last minute of the 6th Criminal Law Amendment due to a special situation where internationally organized car smuggling incidents were rapidly increasing at the time of legislation. In other words, this provision is a hastily enacted law without a sufficient review and discussion period. Even for professional car smugglers, the main purpose of the law, the application of Section 265 of the Penal Code, is consistently failing, and there are hardly any scholars in Germany who recognize the substantial importance of this provision. Insurance fraud under the German Penal Code, which imposes liability for insurance fraud again in cases where the insurance claim does not meet Section 263 of the Penal Code, or where the guilt is exempted due to suspension, and punishes the preliminary act of insurance fraud, cannot be considered a preliminary crime of insurance fraud in a substantial sense.
