흔히 ‘반대통령제(semi-presidential system)’, ‘혼합형 체제’, 혹은 ‘이원집정제’라고 칭하는 프랑스의 대통령제는 1958년 제5공화정 헌법의 출범, 그리고 1962년 대통령 직선제 개헌을 계기로 성립되었다. 프랑스 제5공화정 체제는 드골 대통령의 카리스마적 통치 스타일로 인하여 초기에는 매우 강력한 대통령제의 모습을 보였으나 이후, 현재까지 세 차례의 동거체제를 통하여 의원내각제의 실제적인 부활을 경험하기도 하였다. 2000년 9월, 시락 대통령은 대통령 임기단축을 위한 개헌을 실시하여 대통령 임기와 국회의원 임기를 일치시켰으며 이는 차후 동거체제가 발생할 개연성을 줄임으로써 프랑스 통치체제의 ‘대통령제화(大統領制化)의 길을 넓혔다.
Abstract
Generally defined such as ‘Semi-presidential system’, ‘mixed regime’ or ‘dyarchie’, the presidential system in France was initiated with Fifth Republic in 1958 and completed by the constitutional amendment in 1962 which postulate direct popular election for the presidency. In the early period of Fifth Republic, very strong presidential feature is appeared due to the charismatic personality of General De Gaulle. But the 3 times experiences of ‘cohabitation’ changed radically regime's nature to the extent that ‘the return of Parliamentary system’ could be realized within the same Constitution. President Chirac engaged a Constitutional revision to shorten the presidential tenure for 5 years, aimed to fit to the legislative term. Which probably reduce the possibility of future cohabitation and thus widen the way to the ‘presidentialization’ of french political regime.
