프랑스 제5공화국 정치체제의 변동: 대통령중심제화의 요인에 대한 고찰

헌법규범상으로 볼 때 프랑스 제5공화국의 정치체제는 내각제의 범주에 속하는 것이라 할 수 있다. 비록 대통령의 권위와 권한이 강화되어지긴 했지만 평시에 중재자적 위상을 벗어날 수 있도록 한 것은 아니었다. 그러나 현실에서 나타나는 정치체제는 일시적이고 예외적으로 형성되는 코아비타시옹 체제 동안만 헌법규범에 가까운 것이었을 뿐 대부분의 경우에 대통령이 국정의 실질적 최고책임자인 대통령중심제라 할 수 있다. 이러한 변질은 대통령의 임무 및 권한에 관련한 규정이 개정되어서 이루어진 것이 아니라 대통령이 하원 다수파를 장악함으로써 정치적 역학관계에서 우월성을 확보했기에 가능한 것이었다. 다만 그러한 역학관계를 가능케 하는 제도적 요인이 존재하는데 하나는 1962년 도입된 대통령 직선제이며 또 다른 하나는 2000년 대통령 임기를 7년에서 5년으로 단축하는 헌법 개정이다. 특히 두 번째 요인의 경우는 코아비타시옹의 재출현 가능성을 사실상 차단하는 것이기에 이후 대통령 중심제적 체제는 일시적 ‘파행’을 넘어 ‘제도화’되어졌다고 말할 수 있는 여지를 주고 있다.
Abstract
The political system of the French Fifth Republic can be categorized into a parliamentary regime in constitutional terms. Although the authority and powers of the President of the Republic were strengthened, his role in ordinary situation was not allowed to go beyond that of an arbitrator. In most cases, however, the actual political system is of the presidentialist, in which the President is the effective chief of the government. The political system becomes closer to the constitutional concepts only in the period of temporary and exceptional Cohabitaion system. This transformation was due not to the revision of clauses regarding the missions and competences of the President, but to his domination of parliamentary majority and ascendancy in power relations. This situation is facilitated by two institutional factors: the direct election of the president introduced in 1962; the reduction of the presidential term from seven to five years in 2000. The second factor, in particular, effectively rendered the recurrence of the Cohabitation system impossible. The presidentialist system has thus been ‘institutionalized’ to a certain degree.
