프랑스 혁명중에 태동한 라이시테 원칙의 근원이 당시 프랑스 정치체제를 억압하는 가톨릭의 종교적 압제로부터 벗어나려고 정치적인과 종교적인 것의 분리를 내세웠지만 이는동시에 종교적 자유를 천명하는 보편주의적 원칙에 근간을 둔 것이었다. 라이시테는 이처럼 지배적 종교기관을 정치권력으로부터 분리시키기 위해 고안되었지만 동시에 구교와 신교가 공존할 수 있는 방법을 마련해 주었다. 그렇다면 이러한 라이시테 원칙은 점점 더다양화되고 이질적으로 변하는 오늘날의 프랑스 사회를 통합할 수 있는 도구로써 여전히유효한가? 1989년부터 불거진 히잡 착용문제는 라이시테 원칙의 의미와 실제 적용상의문제점에 대해서 고찰할 수 있는 중요한 계기를 마련한다. 더욱이 “라이시테 원칙에 준거한 공립 중⋅고등학교에서 종교적 외양을 드러내는 옷이나 상징물의 착용에 대한 2004년3월 15일 법”(이하 2004년 법)은 현대 프랑스 사회의 가장 큰 도전인 무슬림에 대해서프랑스가 어떤 입장을 취하는지를 드러내고 있다. 본 논문은 ‘2004년 법’이 프랑스적 정체성과 무슬림 문화와의 갈등을 한층 더 점화시킨 법령으로 보고 라이시테 정신이 프랑스의 종교⋅문화적 갈등의 해결장치로서의 기능을 수행해 왔다면 2004년 법은 프랑스 사회의 제 2의 종교가 된 무슬림이라는 새로운 도전에 대해서 해결장치로서의 기능을 제대로수행하지 못하고 있음을 고찰할 것이다. 2004년 법은 무슬림 근본주의자에 의한 위협의식과 더불어 지구화, 이주민 문제 그리고 유럽통합이 진전되면서 프랑스적인 정체성에 위기를 느끼면서 프랑스적 정체성을 재확립하기 위한 선제적인 행동으로 고찰할 수 있다. 2004년 법이 라이시테의 이름으로 소수 종교인 무슬림을 겨냥하고 있다는 점에서 오늘날라이시테 원칙을 적용하는데 있어서 공화주의적 보편주의가 애초에 갖고 있는 포용적인정신보다는 배제의 성격이 한층 더 강조되고 있음을 고찰할 것이다.
Abstract
Being one of the key values of French Republican Universalism, laîcité principlehas spurred debates over its meanings and practices in the recent years raised bythe so called headscarf affair. The debate over whether Muslim girls should beallowed to wear their headscarves in the public school has exposed exclusionarylaîcité interpretation of laîcité principle in comparaison to the initial devise of theThird Republic. In this article, I will provide an analysis of the principle of laîcité and of itsimportance in French Republican Universalism thought. I argue that the ‘2004 law’diverges from the initial devise of laîcité principle and the ‘2004 law’ will only actto exclude Muslim children from the French education system. The ‘2004 law’seems to bring shift from inclusionary laîcité to exclusionary laîcité as the newlegislation falls short to unite the country but divide it more than ever. Finally,the paper argues that ‘2004 law’ has provided important obstacles to theintegration of certain groups of immigrants, particularly Muslim immigrants.
