Abstract

This article analyzes German debate process on the uniform statutory minimum wage, which was introduced in January 2015 for the first time in its history and after more than ten years of sometimes heated debate. Accordingly, this article explains the puzzles as following: first, what kind of problems happened for German collective bargaining autonomy”(Tarifautonomie) that has been a fundamental principle of German postwar industrial relations, and what are the major reasons why introducing uniform minimum wage system has been discussed so far. Second, what factors differentiated opinions between the trade unions of the manufacturing industry and of the service industry discussing the statutory minimum wage system. Third, does the introduction of the uniform statutory minimum wage system mean complete separation from the tradition of collective bargaining autonomy? To answer the questions above, this study argues that the main reason why Germany decided to introduce uniform minimum wage system is to protect core labour market. In addition, the different views between trade unions representing industry sectors result both from the time lag buffering the effects of deregulation as the influence of neoliberal reforms among sectors and from the gap of manageable institutional assets occupied by each side. Last, this study insists that the ultimate rights to determine the level of minimum wage belong to unions and employers, and the supervisory responsibility belongs to government, which means that the introduction of uniform minimum wage system would not be a complete separation but be a combination. The structural change under the waging decision system is very meaningful because it could provide a clue to the future of German production strategy and coordinated market economies.
