이 글은 독일 금속산업의 단체협약에서 주당 35시간제가 도입되는 노동정치 과정을 분석한다. 1967년에 주 40시간 노동이 시행된 이래 금속노조는 노동시간 단축을 꾸준히 추진했지만 1970년대 말에 실패하고 말았다. 주 35시간제의 돌파구는 1984년에 마련되었다. 금속노조는 자신의 의지를 관철하기 위해 두 단계의 투쟁을 거쳤다. 첫 단계는 단체교섭 이전에 조합원의 동의뿐 아니라 사회적 공감을 형성하고자 했다. 두 번째 단계는 교섭이 이루어지는 과정에서 효과적인 파업을 통해 사용자를 압박했다. 그 결과 노동시간 단축과 유연화의 교환을 핵심으로 하는 단체협약이 체결되었다. 노동조합은 40시간 이하로는 단 1분도 단축할 수 없다는 사용자의 금기를 허물고 주당 38.5시간을 쟁취했지만, 사용자는 노동시간 유연화의 초석을 닦았다. 노동시간 단축과 유연화의 교환은 그 이후 노사간 노동시간 정책의 틀로 자리잡았다. 노동시간이 1987년에 37시간, 1990년에 35시간으로 합의되는 과정에서 유연화도 진척되었다. 향후 노동시간 단축은 독일 전역에서 35시간이 정착된 이후 재점화될 것으로 전망된다. 한국에서 노동시간 단축을 추진하는 세력은 독일 금속노조가 채택한 전략을 짚어 볼 필요가 있다.
Abstract
This article analyzes the political process of introducing the 35-hour work week system in collective bargaining in the German metal industry. Since the 40-hour work week was enforced in 1967, the metal union had steadily pushed for a reduction in working hours, only to fail in the late 1970s. The breakthrough of the 35-hour work week came in 1984. The metalwork union went through two stages of struggle to carry out its will. The first step was to create social supports as well as consent from union members prior to collective bargaining. The second step was to pressure employers through effective strike tactics during the bargaining process. The resulting collective agreement was characterized by the exchange of working time reduction and flexibility. Whereas the labor succeeded in reducing weekly working hours to 38.5, demolishing the taboo of employers, the latter laid the foundation for flexible working hours. The exchange has since become a framework for working time policies. As working hours were reduced to 37 hours in 1987 and 35 hours in 1990, flexibility also progressed.
