2021년 3월 유럽의회는 기업 실사와 책임에 대한 지침 초안 결의안을 채택하였다. 해당 결의안은 기업의 공급망 내에서 발생하는 인권 침해와 부정적인 환경 영향을 식별, 예방, 완화 및 설명하기 위해 의무적인 기업 실사 의무를 도입하는 것이다. 이에 본 논문에서는 EU 기업실사의무의 주요 내용과 의의를 정리하고, 향후 EU 내에서의 의결 처리 과정과 시장 및 제3국과의 무역에 미치는 영향에 관해 분석하였다. 이에 본 연구에서는 기존 EU 공동시장 규제정책 이론에서 생산규제와 공정규제가 역내 및 역외에 미치는 영향에 대해 고찰하고, 기업실사의무가 공정규제로서 EU 공동시장의 이익을 높일 것임을 분석하였다. EU 차원에서의 기업실사 의무화가 시행되면, 역외 국가는 대 EU 상품과 서비스에서 노동 및 인권실사를 입증할 책임을 지게 됨으로써 사회규범 전반의 변화가 필요하게 될 것이다.
Abstract
In March 2021, the European Parliament adopted a draft directive on corporate due diligence and accountability. The directive is to introduce mandatory corporate due diligence obligations to identify, prevent, mitigate and explain human rights violations and negative environmental impacts in the enterprise's supply chain. In this paper, the main contents and significance of EU due diligence obligations are summarized, and the process of resolution in the EU and the impact on trade with the market and third countries are analyzed. In this study, we examined the impact of production regulation and process regulation on the region and the outside in the existing EU joint market regulation policy theory, and analyzed that the duty to conduct business inspection will increase the interests of the EU joint market as fair regulation.,If the EU-level mandatory inspection of companies is implemented, offshore countries will be responsible for demonstrating labor and human rights inspections in EU goods and services, which will require a change in overall social norms.
