유엔 기업과 인권 이행원칙(UNGPs)을 바탕으로 한 공급망 실사법이 유럽 각국을 중심으로 확산하고 있는 가운데 2024년 6월에는 인권과 환경을 두 축으로 하는 EU 기업지속가능성 실사지침(CSDDD)이 채택되었다. 가속화되고 있는 글로벌 경제화와 기술혁신에 따른 초연결성으로 인해 기업들이 전례 없이 복잡하게 연계된 글로벌 공급망 속에서 밀접하게 상호작용을 하고 있다는 점을 감안하면, EU차원에서 최초로 도입되는 실사 법안은 향후 전세계 기업들에게 다양한 직간접적인 영향을 줄 것으로 예상된다. 이러한 국제사회의 흐름 속에 특히 수출중심형 산업구조를 가진 한국의 경우 체계적인 실사(Due Diligence)대응이 요구되고 있다. 이에 따라 본 연구는 2018~2023년 기업 인권 벤치마크(CHRB) 평가결과에서 ‘기업 인권 벤치마크 핵심 유엔 기업과 인권 이행원칙 지표’ 해당 데이터를 추출하여 글로벌 기업들의 인권실사 현황을 분석해 보았다. 또한 이를 2024년 한국 주요 12개 기업 대상 동 지표기반 평가결과와 비교하여 이행현황을 분석하였다. 이를 통해 도출된 결과와 함의를 바탕으로 효과적인 실사 체계 구축 및 추진을 위한 정책 방향을 모색해 보았다.
Abstract
As supply chain due diligence laws based on the UN Guiding Principles on Business and Human Rights (UNGPs) are spreading throughout European countries, the EU Corporate Sustainability Due Diligence Directive (CSDDD) focusing on human rights and environment were adopted in June 2024. Considering that companies are closely interacting in an unprecedentedly complex global supply chains due to rapid economic globalization and hyper-connectivity caused by technological innovation, the due diligence law being introduced for the first time at the EU level is expected to have a wide range of direct and indirect effects on companies around the world. In particular, South Korea, which has an export-oriented industrial structure, needs a systematic response to the regional legislation of corporate due diligence in EU. Accordingly, this study analyzed the status of human rights due diligence of global companies based on the extracted data corresponding to the ‘CHRB Core UNGP Indicators’ among the CHRB assessment results from 2018 to 2023. In addition, we compared this with the assessment results based on the same indicators for 12 major South Korean companies in 2024 to analyze the implementation status and explore the implications and directions for an effective due diligence system based on the results.
