독일의 성인지 예산제도의 법적 근거 및 내용

1995년 제4회 유엔세계여성대회인 북경회의에서 ‘성주류화(Gender Mainstreaming)라는 행동강령이 발표되었는데 여기에서 양성평등의 문제를 전략적으로 접근하고 더욱 적극적으로 영향력을 미치게 되었다. 세계 곳곳에서 여성운동, 그리고 여성고위직전문가의 등장에도 불구하고 현실적인 측면에서는 끊임없이 성적 불균형이 있었으므로 공식적으로 성차별없는 평등대우원칙을 천명하는 것이 필요했던 것이다. 이러한 천명을 뒷받침해주는 구체적인 정책적 기조로 이 북경회의에서 국가 및 지방자치단체의 성 평등기구 및 행정조직, 모든 정책에서의 성별영향평가, 모든 정책의 성별분리통계, 성인지 예산 및 젠더교육과 훈련 등을 성주류화의 방법과 도구로서 제안하였는데 그 중의 하나인 성인지 예산부분은 국가예산의 편성때 양성평등정책의 구체적인 실현을 위하여 필요하고도 현실적인 부분이었다. 독일 뿐만 아니라 세계적으로 성인지예산제도는 양성평등의 원칙, 기회균등의 원칙, 성공평성의 원칙을 필수적인 구성요건으로 하므로 이를 지키기 위한 분석과 계획의 수립과정을 통하여 여성정책뿐만 아니라 가족 및 사회정책에 기여하는 바가 크다. 현재 독일의 경우 성인지예산제도를 명문으로 공표한 실정법적 근거는 존재하지 않지만 양성평등원칙을 그 근간으로 내세운 몇몇의 정책적인 입법을 통하여 간접적으로 성인지예산을 뒷받침하고 있으며, EC조약이나 유럽인권헌장, 독일 기본법, 연방양성평등법 및 연방전문위원임용에 관한 법 등이 성인지예산제도에 대한 해석원칙으로서 법적 근거가 된다. 현재 성인지예산의 운용은 정부주도 방식에서 민간기구와 시민단체에 그 역할이 위임되는 과정에 있고 위에서부터 아래로의 재정 정책적 방법과 아래서 위로의 시민사회의 참여에 의한 방법이 그 적절한 역할분담에 의하여 현실화 되어가고 있다.
Abstract
The first gender budget initiative was launched in the mid-1980s in Australia. Gender-sensitive budgeting is among the issues raised and incorporated in the Platform for Action at the Fourth World Conference on Women in Beijing in 1995. Gender budgets have come to be an integral part of the gender mainstreaming approach. Gender budgeting is an application of gender mainstreaming in the budgetary process. It means a gender-based assessment of budgets, incorporating a gender perspective at all levels of the budgetary process and restructuring revenues and expenditures in order to promote gender equality. Legally speaking, gender budgeting is based on Art. 3 II. of the constitution (the Basic Law), Art 2, 3 III. and Art. 13 of the Amsterdam-Treaty, equal opportunities legislation, § 2 of the Federal Equal Opportunities Act and the Federal Act on Appointment to Bodies. Important gender budgeting aspects were defined under the gender mainstreaming process pursued by the Federal Government until the year 2006, especially with regard to assessing the impact of legislation. After 2006 the gender mainstreaming process, although binding to member States as a European strategy, came more or less to a halt at the national level. The principle of integrating the gender perspective into all social and political processes is increasingly gaining acceptance and is being applied more and more frequently in politics and in public-sector, economic and social programmes. Its impacts will remain limited, however, unless it also becomes an integral factor within the budgets of the central government, municipalities, and public-sector institutions.
